5.4: The Congregation of the Holy Inquisition



Preamble

    The object of the Holy Inquisition is to guarantee the triumph of the True Faith through the restless hunt chase for all kinds of heresy, as his main goal is to ensure the re-instatement of lost believers in the Aristotelian community. It is active for the Aristotelian unity, under the Congregation of the same name.



Hierarchy in the Congregation of the Holy Inquisition

    Article 1.1 The hierarchy is established as follows:
    Chancellor of the Congregation of the Holy Inquisition, also known as the Grand Inquisitor Major.
    Vice-Chancellor of the Congregation of the Holy Inquisition, also known as the Grand Inquisitor.
    Local Cardinal Inquisitor
    Second, third, ..., local Cardinal Inquisitor
    Prefect.
    Deputy-Prefect.
    Missi Inquisitionis and Episcopal Prosecutors General.


Leaders of the congregation and of the Superior Council

    Article 2.1 The Congregation of the Holy Inquisition is run by the Chancellor and Vice-Chancellor: they are Roman Cardinal electors appointed for that purpose by their peers gathered in the Curia.

    Article 2.2 The Vice-Chancellor, exercising substitutive powers, has the same rights, responsibilities and prerogatives reserved for the Chancellor therefore, if necessary, the term Chancellor also indicates the prerogative of the Vice-Chancellor.

    Article 2.3 The Chancellor can make use of the collaboration of the Cardinal Inquisitors chosen among the Cardinals of each geodogmatic region, by appointing and removing them; these Cardinals are responsible for the Inquisition in the their own geodogmatic region and consitute a local Holy Inquisition.

    Article 2.4 The Chancellor, the Vice-Chancellor and the Cardinal Inquisitors constitute the High Council. This Council is the instrument used by the leaders of the Congregation in order to coordinate and superintend the works. The Superior Council is also a place dedicated to the definition of strategies to defeat the heresy and to hunt the Creature Without Name to make the True Faith finally triumph.

    Article 2.5 The local Cardinal Inquisitor is also responsible for preparing the procedural assignments of Missi Inquisitionis, revoking the Episcopal Prosecutors and, if specifically delegated, appointing and dismissing the Episcopal Prosecutor General.


Prefects of the Holy Inquisition

    Article 3.1 Each local Holy Inquisition may avail itself of the collaboration of a Prefect and possibly one or more Deputy-prefects. These officers are appointed by the Chancellor after consultation with the local Cardinal Inquisitor. The Prefect is functionally subjected to the related Cardinal Inquisitor.

    Article 3.2 In case of vacancy of the role of local Cardinal Inquisitor, the Prefect may be admitted at the High Council as an auditor, however he has no decision-making power unless expressly requested or delegated.

    Article 3.3 Each Missus Inquisitionis can access to the role of Prefect; if possible, a Missus that received his priestly vows will be favourited.

    Article 3.4 The Prefect co-operates with the local Cardinal Inquisitor on the good functioning of the Holy Inquisition, specifically he supervises the Episcopal and Archiepiscopal courts.


Status of the Missus Inquisitionis

    Article 4.1 The Missus Inquisitionis is an officer of the Inquisition who has to provide for the missions of the Congregation.

    Article 4.2 Any clergy Aristotelian, who successfully attended a special seminar organized by the Congregation of the Inquisition, which guarantees the legal and oratorical qualities of each applicant, can gain admittance to the status of Missus inquisitionis

    Article 4.3 The Missus Inquisitionis are freely appointed and dismissed by the Chancellor of the Holy Inquisition, after consultation with the local Cardinal Inquisitor.

    Article 4.4 The Missus Inquisitionis may be associated in the exercise of his duties, as long as the local Cardinal Inquisitor authorizes it, to a layman of Aristotelian confession of his choice.

    Article 4.5 The Missus Inquisitionis is allowed to use the heraldic insignia of the Inquisition.


Of the Episcopal Prosecutors General

    Article 5.1 The Episcopal Prosecutors General (EPG) is appointed and dismissed by the Chancellor of the Congregation of the Holy Inquisition. The prerogative to appoint and dismiss may be specifically delegated to the local Cardinal Inquisitor.

    Article 5.2 There is only one EPG for each geodogmatic region, which is under a single Episcopal Assembly.

    Article 5.3 When appointed, the EPG is charged with one or more duties, as stated in this document. The decree of appointment must recall the Articles of the Status, which identify his duties and tasks. The Chancellor may entrust additional tasks as long as they do not adversely affect the prerogatives of other members of the Congregation.

    Article 5.4 The EPG can be responsible for managing, independently and under his responsibility, the national officiality. He also manage appointments and revocations of its competence, as well as the acts necessary to the proper course of ordinary justice related to the official episcopal and archiepiscopal status.

    Article 5.5 The EPG can coordinate and supervise the work of individual Episcopal procurators under its jurisdiction. In this case he is their hierarchic superior.

    Article 5.6 When there is no Episcopal Prosecutor, the EPG may replace him as Prosecutor and collaborate with the Bishop or Archbishop at the Episcopal or Archiepiscopal Court.


Of the secrecy

    Article 6.1 All members of the Congregation are bound to secrecy as part of their duties.

    Article 6.2 Whoever violates secrecy of the Inquisition, in addition to the judgment and the penalties that will be imposed, is affected by a perpetual inquisitorial interdict, remissibile only by the Chancellor of the Holy Inquisition.


The missions of the Inquisition

    Article 7.1 The Holy Inquisition must work, in all cases, in order to get the abjuration of all known faithful who lost there way, independently of any other consideration. The Holy Inquisition has as its main weapon the verb. The Holy Inquisition administers the Justice of the Church in all its forms.

    Article 7.2 The Holy Inquisition is in charge of the direct administration of extraordinary justice, as specifically defined by the Canon Law. It supervises the homogeneity in the ecclesiastical jurisdiction, in particular it is responsible of the resolution of questions of interpretation and application of the Canon Law or secondary regulations (Status of Episcopal Assemblies, internal regulations, etc ...).
    It oversees the smooth running of all operations codified or normed by the Holy Aristotelian Church.

    Article 7.3 The Holy Inquisition is in charge of ensuring the fair administration of ordinary justice in the Church, in all courts that depend on the Inquisition. It has powers of control and coordination of the episcopal tribunals, the Penitentiary, the Roman Rota and the papal court; it may work as a replacement when those courts are not able to operate. Its mission is to organize the clerical and prosecutor training of all the figures related to the Congregation.

    Article 7.4 In order to ensure the perfect impartiality of the courts of justice of the Church, through the Chancellor of the Holy Inquisition, it may temporarily replace judiciary members or people otherwise related to the court, who have previously assessed the case in other instances.

    Article 7.5 It helps the episcopate in its negotiations with the temporal power to create Episcopal tribunals. It collaborates and signs agreements (in agreement with the nunciature) for judicial cooperation in general as well as in the specific use of the courts IG and application of penalties through the secular justice.

    Article 7.6 The Holy Inquisition occupies a police function inside the Aristotelian church. It has a mandate to investigate the errors committed by members of the clergy in the exercise of their ministries. It can transmit the results of its investigations to the Apostolic Penitentiary in anticipation of pronunciation of disciplinary sanctions, or urge to open proceedings.

    Article 7.7 The Holy Inquisition is in charge of directing the information services of the Aristotelian Church. In this respect, it has general powers of investigation. It is authorized to investigate any case or any individual who appears to be of interest, being careful, however, not to disturb the good and ordinary administration of spiritual or temporal justice.

    Article 7.8 The Holy Inquisition has the task of holding the records of episcopal, archiepiscopal or consistorial issued interdictions. Inclusion in the register ensures the universal recognition of the interdiction measure. To this end, the ecclesiastical authority concerned must notify the measures to the Holy Inquisition.

    Article 7.9 Cases of recognition of a person and of corpses are reserved to the Extraordinary Justice, and therefore to the Holy Inquisition.


Specific competences of the Inquisition

    Article 8.1 The Holy Inquisition, pending the investigation, may issue precautionary measures or suspension from office in the Church against the parties involved.

    Article 8.2 A cleric under judgment is suspended from his duties by the proceeding court.

    Article 8.3 The Holy Inquisition can communicate information and news to every ecclesiastical authority to which it believes is necessary. It collaborates with various authorities in case of investigations and assessments.

    Article 8.4 The Holy Inquisition can claim for itself a case or a matter related, even indirectly, to the Justice of the Church and exclude any other authority, except the Holy Father and the Sacred College.

5.4: La Congrégation de la Sainte Inquisition



Préambule

    La Sainte Inquisition a pour objectif d’assurer le triomphe de la Vraie Foi avec la chasse incessante de toutes les manifestations de l’hérésie, puisque son objectif principal est d’assurer la réintégration des croyants perdus dans la communauté aristotélicienne. Elle est active pour l’unité aristotélicienne, sous la Congrégation du même nom.



Hiérachie dans la Congrégation de la Sainte Inquisition

    Article 1.1 La hiérarchie est établie comme suit :
    Chancelier de la Congrégation de la Sainte Inquisition, également connu comme le Grand Inquisiteur Major.
    Vice-Chancelier de la Congrégation de la Sainte Inquisition, également connu comme le Grand Inquisiteur.
    Cardinal-Inquisiteur local
    Deuxième, troisième, ..., Cardinal-Inquisiteur local
    Préfet.
    Vice-préfet.
    Missi Inquisitionis et Procureurs Généraux Épiscopaux.


Les dirigeants de la Congrégation et du Conseil Supérieur

    Article 2.1 La Congrégation de la Sainte Inquisition est dirigée par le Chancelier et Vice-Chancelier : ils sont des Cardinaux électeurs romains désignés à cet effet par leurs pairs réunis à la Curie.

    Article 2.2 Le Vice-Chancelier, exerçant un pouvoir substitutif, a les mêmes droits, responsabilités et prérogatives réservées au Chancelier donc, si nécessaire, le terme Chancelier indique aussi la prérogative du Vice-Chancelier.

    Article 2.3 Le Chancelier peut faire usage de la collaboration de Cardinaux-Inquisiteurs choisis parmi les Cardinaux de chaque zone géodogmatique, en les nommant et révoquant; ces cardinaux sont responsables de l’Inquisition dans le leur propre zone géodogmatique et constitue une Sainte Inquisition locale.

    Article 2.4 Le Chancelier, Vice-Chancelier et les Cardinaux-Inquisiteurs constituent le Conseil Supérieur. Ce Conseil est l’instrument utilisé par les dirigeants de la Congrégation pour coordonner et diriger les travaux. Le Conseil Supérieur est également un lieu dédié à la définition de stratégies pour vaincre l’hérésie et chasser la créature Sans Nom pour faire triompher la Vraie Foi.

    Article 2.5 Le Cardinal-Inquisiteur local est également chargé de préparer les missions de procédure de Missi Inquisitionis, la révocation des procureurs épiscopaux et, si expressément délégués, de la nomination et de révocation du Procureur Général Épiscopal.


Préfets de la Sainte Inquisition

    Article 3.1 Chaque Sainte Inquisition locale peut se prévaloir de la collaboration d’un Préfet et possiblement d’un ou plusieurs Vice-préfets. Ceux-ci sont nommés par le Chancelier, après consultation avec le Cardinal-Inquisiteur local. Le Préfet est soumis par sa fonction au Cardinal-Inquisiteur relatif.

    Article 3.2 En cas de vacance du rôle de Cardinal-Inquisiteur local, le Préfet peut être admis au Conseil Supérieur en tant qu’auditeur, mais il n’a aucun pouvoir décisionnel, sauf demande expresse ou déléguée.

    Article 3.3 Chaque Missus Inquisitionis peut accéder au rôle du Préfet; si possible, un Missus ayant prononcé les vœux sacerdotaux sera favorisé.

    Article 3.4 Le Préfet coopère avec le Cardinal-Inquisiteur local pour le bon fonctionnement de la Sainte Inquisition, spécifiquement il supervise les tribunaux Archiépiscopaux et Épiscopaux.


Statut du Missus Inquisitionis

    Article 4.1 Le Missus Inquisitionis est un officier de l’Inquisition qui doit assurer les missions de la Congrégation.

    Article 4.2 Tous membres du clergé aristotélicien, qui a assisté avec succès à séminaire spécial organisé par la Congrégation de l’Inquisition, qui garantit les qualités juridiques et oratoires de chaque candidat, peuvent être admis au statut de Missus Inquisitionis.

    Article 4.3 Le Missus Inquisitionis est librement nommé et révoqué par le Chancelier de la Sainte Inquisition, après consultation avec le Cardinal-Inquisiteur local.

    Article 4.4 Le Missus Inquisitionis peut être associé dans l’exercice de ses fonctions, tant que le Cardinal-Inquisiteur local l’autorise, il, à un laïc de la confession aristotélicienne de son choix.

    Article 4.5 Le Missus Inquisitionis est autorisé à utiliser les insignes héraldiques de l’Inquisition.


Des Procureurs Généraux Épiscopaux

    Article 5.1 Le Procureur Général Épiscopal (PGE) est nommé et révoqué par le Chancelier de la Congrégation de la Sainte Inquisition. La prérogative de nommer et révoquer peut être spécifiquement délégué au Cardinal-Inquisiteur local.

    Article 5.2 Il n’y a qu’un PGE pour chaque zone géodogmatique, qui est sous une seule Assemblée épiscopale.

    Article 5.3 Lors de sa nomination, l’EPG est chargé avec une ou plusieurs fonctions, comme indiqué dans le présent document. Le décret de nomination doit rappeler les articles du Statut, qui identifient ses fonctions et les tâches. Le Chancelier peut confier des tâches supplémentaires tant qu’ils ne portent pas atteinte aux prérogatives des autres membres de la Congrégation.

    Article 5.4 L’EPG peut-être responsable de la gestion, de manière indépendante et sous sa responsabilité, de l’officialité national. Il gère également les nominations et révocations de sa compétence, ainsi que les actes nécessaires pour le bon déroulement de la justice ordinaire en rapport avec les statuts épiscopaux et archiépiscopaux officiels.

    Article 5.5 L’EPG peut coordonner et superviser le travail des Procureurs Épiscopaux individuels sous sa juridiction. Dans ce cas, il est leur supérieur hiérarchique.

    Article 5.6 Lorsqu’il n’y a pas de Procureur Épiscopal, l’EPG peut le remplacer en tant que Procureur et collaborer avec l’Évêque ou Archevêque au tribunal Archiépiscopal ou Épiscopal.


Du secret

    Article 6.1 Tous les membres de la Congrégation sont tenus au secret dans le cadre de leurs fonctions.

    Article 6.2 Quiconque viole le secret de l’Inquisition, en plus du jugement et les sanctions qui seront imposées, est frappé par un interdit inquisitorial perpétuel, rémissible seulement par le Chancelier de la Sainte Inquisition


Les missions de l’Inquisition

    Article 7.1 La Sainte Inquisition doit travailler, dans tous les cas, afin d’obtenir l’abjuration de tous les fidèles reconnus d’avoir perdu le droit chemin, indépendamment de toute autre considération. La Sainte Inquisition a comme arme principale du verbe. La Sainte Inquisition administre la Justice de l’Église sous toutes ses formes.

    Article 7.2 La Sainte Inquisition est responsable de l’administration directe de la justice extraordinaire, qui est expressément définie par le Droit Canon. Elle supervise l’homogénéité dans la juridiction ecclésiastique, en particulier, elle est responsable de la résolution des questions d’interprétation et d’application du Droit Canon ou des règlementations secondaires (Statuts des assemblées épiscopales, règlements internes, etc ...).
    Elle veille au bon fonctionnement de toutes les opérations codifiées ou déterminées par la Sainte Église Aristotélicienne.

    Article 7.3 La Sainte Inquisition est chargée de veiller à la bonne administration de la justice ordinaire dans l’Église, dans tous les tribunaux qui dépendent de l’Inquisition. Elle dispose de pouvoirs de contrôle et de coordination des tribunaux épiscopaux, de la Pénitencerie, de la Rote Romaine et de la cour pontificale; elle peut fonctionner comme un remplacement lorsque ces tribunaux ne sont pas en mesure de fonctionner. Elle a pour mission d’organiser la formation cléricale et de procureur de toutes personnes liées à la Congrégation.

    Article 7.4 Afin d’assurer l’impartialité parfaite des cours de justice de l’Église, à travers le Chancelier de la Sainte Inquisition, elle peut remplacer temporairement des membres de la magistrature ou les personnes autrement liées à la cour, qui ont déjà évalué le cas dans d’autres instances.

    Article 7.5 Elle assiste l’épiscopat dans ses négociations avec le pouvoir temporel pour la création de tribunaux Épiscopaux. Elle collabore et signe des accords (en accord avec la nonciature) en général pour la coopération judiciaire, ainsi que pour l’utilisation spécifique des tribunaux IG et l’application de sanctions à travers la justice séculière.

    Article 7.6 La Sainte Inquisition occupe une fonction de police à l’intérieur de l’Église aristotélicienne. Elle a pour mandat d’enquêter sur les erreurs commises par des membres du clergé dans l’exercice de leurs ministères. Elle peut transmettre les résultats de ses enquêtes à la Pénitencerie apostolique en prévision de la prononciation de sanctions disciplinaires, ou inciter à ouvrir une procédure.

    Article 7.7 La Sainte Inquisition est chargée de diriger les services d’information de l’Église aristotélicienne. À cet égard, elle a des pouvoirs généraux d’enquête. Elle est autorisée à enquêter sur tous les cas ou toute personne qui semble être d’intérêt, en faisant attention, cependant, de ne pas perturber le bon et ordinaire administration de la justice spirituelle ou temporelle.

    Article 7.8 La Sainte Inquisition a la tâche de tenir les registres des interdictions épiscopales, archiépiscopales ou consistoriales émises. L’inclusion dans le registre assure la reconnaissance universelle de la mesure d’interdiction. À cette fin, l’autorité ecclésiastique concernée doit notifier l’émission de mesures à la Sainte Inquisition.

    Article 7.9 Les cas de reconnaissance d’une personne ou d’un cadavre sont réservés à la justice extraordinaire, et donc à la Sainte Inquisition.


Les compétences particulières de l’Inquisition

    Article 8.1 La Sainte Inquisition, en attendant l’enquête, peut délivrer des mesures de précaution ou de suspension de fonction dans l’Église contre les parties concernées.

    Article 8.2 Un religieux sous jugement est suspendu de ses fonctions par le tribunal d’instance.

    Article 8.3 La Sainte Inquisition peut communiquer des informations et des nouvelles à chaque autorité ecclésiastique auquel elle croit être nécessaire. Elle collabore avec diverses autorités en cas d’enquêtes et d’évaluations.

    Article 8.4 La Sainte Inquisition peut revendiquer pour elle-même un cas ou une question liée, même indirectement, à la Justice de l’Église et exclure toute autre autorité, à l’exception du Saint-Père et du Sacré Collège.

5.4: La Congregazione della Santa Inquisizione



Preambolo

    La Santa Inquisizione ha per oggetto di garantire il trionfo della Vera Fede con la caccia incessante a tutte le manifestazioni dell’eresia, essendo il suo obiettivo primo riuscire a garantire la reintegrazione degli smarriti nella comunità aristotelica. Essa opera nell’unità Aristotelica e sotto l’omonima Congregazione.



Della Gerarchia nella Congregazione della Santa Inquisizione

    Articolo 1.1 La gerarchia è così stabilita:
    Cancelliere della Congregazione della Santa Inquisizione, detto anche Grande Inquisitore Maggiore.
    Vice - Cancelliere della Congregazione della Santa Inquisizione, detto anche Grande Inquisitore.
    Cardinale Inquisitore locale.
    Secondo, Terzo, …, Cardinale Inquisitore locale.
    Prefetto.
    Vice-Prefetto.
    Missi Inquisitionis e Procuratori Episcopali Generali.


Dei vertici della Congregazione e del Consiglio Superiore

    Articolo 2.1 La Congregazione della Santa Inquisizione è diretta da un Cancelliere e da un Vice-Cancelliere: essi sono Cardinali romani elettori designati a tal fine dai loro pari riuniti nella Curia.

    Articolo 2.2 Il Vice-Cancelliere, esercitando poteri sostitutivi, ha gli stessi diritti, doveri e prerogative riservate al Cancelliere pertanto, ove occorra, la dizione Cancelliere indica, sempre, anche una prerogativa del Vice-Cancelliere.

    Articolo 2.3 Il Cancelliere si avvale, nominando e revocando, della collaborazione dei Cardinali inquisitori scelti fra i Cardinali di ogni zona geodogmatica; tali Cardinali sono responsabili della Santa Inquisizione sull’estensione del territorio della zona geodogmatica di competenza definita come Santa Inquisizione locale.

    Articolo 2.4 Il Cancelliere, il Vice-Cancelliere ed i Cardinali inquisitori costituiscono il Consiglio Superiore. Tale Consiglio è lo strumento utilizzato dai vertici della Congregazione per il coordinamento e supervisione dei lavori. Il Consiglio Superiore è altresì il luogo deputato alla definizione delle strategie per sconfiggere l’eresia e cacciare la Creatura Senza Nome al fine che trionfi la Vera Fede.

    Articolo 2.5 Il Cardinale Inquisitore locale è altresì incaricato di predisporre i Commissionamenti dei Missi Inquisitionis, di revocare i Procuratori Episcopali e, se specificatamente delegato, di nominare e revocare i Procuratori Episcopali Generali.


Dei Prefetti della Santa Inquisizione

    Articolo 3.1 Ogni Santa Inquisizione locale può avvalersi della collaborazione di un Prefetto ed eventualmente di uno o più Vice-Prefetti. Tali figure sono nominate dal Cancelliere sentito il Cardinale Inquisitore locale. Il Prefetto è funzionalmente sottoposto al Cardinale Inquisitore di riferimento.

    Articolo 3.2 In caso di vacanza del ruolo di Cardinale Inquisitore locale, il Prefetto può essere ammesso al consiglio superiore in qualità di uditore, è comunque escluso un potere decisionale se non espressamente richiesto o delegato.

    Articolo 3.3 Possono accedere al ruolo di Prefetto i missi inquisitionis, preferibilmente sarà privilegiato un missus che abbia ottenuto i voti sacerdotali.

    Articolo 3.4 Il Prefetto collabora con il Cardinale Inquisitore locale per lo svolgimento del buon andamento della Santa Inquisizione, in particolare si occupa della supervisione dei Tribunali Episcopali ed Arciepiscopali.


Dello status di missus inquisitionis

    Articolo 4.1 Il missus inquisitionis è un funzionario dell'Inquisizione che ha l'incarico di provvedere alle missioni della Congregazione.

    Articolo 4.2 Possono accedere allo status di missus inquisitionis i membri del clero aristotelico che hanno seguito un seminario specifico organizzato dalla Congregazione dell'Inquisizione e che garantisce le qualità oratorie e giuridiche di ogni richiedente.

    Articolo 4.3 I missi inquisitionis sono liberamente nominati e revocati dal Cancelliere della Santa Inquisizione, sentito il Cardinale Inquisitore locale di riferimento.

    Articolo 4.4 Il missus inquisitionis può associarsi nell'esercizio delle sue missioni, purché il Cardinale Inquisitore locale l'autorizzi, ad un laico di confessione aristotelica di sua scelta.

    Articolo 4.5 Il missus inquisitionis è autorizzato a sfoggiare le insegne dell'inquisizione.


Dei Procuratori Episcopali Generali

    Articolo 5.1Il Procuratore Episcopale Generale (PEG) è nominato e revocato dal Cancelliere della Congregazione della Santa Inquisizione. La prerogativa di nomina e revoca può essere specificatamente delegata al Cardinale Inquisitore locale.

    Articolo 5.2 Può esserci un solo PEG per ogni zona geodogmatica ricadente sotto una unica Assemblea Episcopale.

    Articolo 5.3 All'atto della nomina vengono conferiti al PEG uno o più compiti secondo il presente Statuto. Il Decreto di nomina deve richiamare gli articoli dello Statuto che individuano i compiti e le mansioni. Chi procede alla nomina può conferire ulteriori compiti purché essi non ledano le prerogative di altre figure legate alla Congregazione.

    Articolo 5.4 Il PEG può avere il compito di gestire, in via autonoma e sotto la sua piena responsabilità, l'ufficialità nazionale. Anche provvedendo a nomine e revoche di sua competenza oltre che agli atti necessari al buon andamento della giustizia ordinaria afferente le ufficialità episcopali ed arciepiscopali.

    Articolo 5.5 Il PEG può coordinare e supervisionare il lavoro dei singoli Procuratori Episcopali ricadenti sotto la sua giurisdizione. In questo caso egli è loro superiore gerarchico.

    Articolo 5.6 Il PEG può, in quei casi dove non vi è un Procuratore Episcopale, sostituirsi ad esso nei compiti propri del Procuratore ovvero collaborare con il Vescovo o l'Arcivescovo presso il Tribunale Episcopale o Arciepiscopale.

Della Segretezza

    Articolo 6.1 Tutti i membri della Congregazione sono tenuti al segreto nel quadro delle loro funzioni.

    Articolo 6.2 Chi infrange la segretezza dell'inquisizione, oltre al giudizio ed alle pene che gli verranno comminate, è colpito da interdetto inquisitoriale perpetuo, remissibile solo dal Cancelliere della Santa Inquisizione.


Delle missioni dell'Inquisizione

    Articolo 7.1 La Santa Inquisizione vigila, in tutti i casi, affinchè si ottenga l'abiura di tutti gli smarriti che riesce a identificare, indipendentemente da qualsiasi altra considerazione. Ha per principale arma il verbo. La Santa Inquisizione amministra la Giustizia della Chiesa in ogni sua forma.

    Articolo 7.2 La Santa Inquisizione ha in carico l'amministrazione diretta della giustizia straordinaria, nel quadro specificamente definito dal corpo delle norme del diritto canonico. Vigila sull'unità giurisprudenziale nell'ambito della giurisdizione ecclesiastica, in particolare compete ad essa derimere questioni di interpretazione ed applicazione del diritto canonico e della normativa secondaria (Statuti delle Assemblee Episcopali, Regolamenti interni, ecc…).
    Sovraintende al regolare svolgimento di tutte le operazioni codificate o normate dalla Santa Chiesa Aristotelica.

    Articolo 7.3 La Santa Inquisizione ha l'incarico di garantire la buona amministrazione della giustizia della Chiesa ordinaria, in tutti i tribunali che da Ella dipendono. Dispone di poteri di controllo e di coordinamento dei tribunali episcopali, della penitenzeria, della rota romana e del tribunale pontificio, esercita in essi potere sostitutivo quando tali tribunali non sono in grado di operare. Ha l'incarico di organizzare la formazione dei procuratori ecclesiastici e di tutte le figure attinenti la Congregazione.

    Articolo 7.4 Al fine di assicurare la perfetta imparzialità dei tribunali della Giustizia della Chiesa, attraverso il Cancelliere della Santa Inquisizione, sostituisce temporaneamente i membri giudicanti o comunque afferenti alle corti, che abbiano già precedentemente valutato il caso in altra istanza.

    Articolo 7.5 Assiste l'episcopato nei suoi negoziati con il potere temporale per la creazione di tribunali episcopali. Collabora e stipula convenzioni (anche all'interno dei Concordati, in accordo con la Nunziatura) per la cooperazione giudiziaria in senso generale oltre che nello specifico utilizzo dei tribunali IG e dell'applicazione delle pene attraverso la giustizia secolare.

    Articolo 7.6 La Santa Inquisizione occupa una funzione di polizia interna alla chiesa Aristotelica. Ha l'incarico di indagare sugli errori commessi dai membri del clero nell'esercizio dei loro ministeri. Può trasmettere il risultato delle sue indagini alla Penitenzieria Apostolica in previsione della pronunzia di sanzioni disciplinari, o sollecitare la stessa ad aprire procedimenti.

    Articolo 7.7 La Santa Inquisizione ha l'incarico di dirigere i servizi di informazioni della Chiesa Aristotelica. A tale riguardo, dispone di poteri generali d'indagine. È autorizzata ad indagare su qualsiasi causa o qualsiasi individuo che gli sembri presentare un interesse, facendo attenzione, tuttavia, a non turbare la buona e ordinaria amministrazione della giustizia spirituale o temporale.

    Articolo 7.8 La Santa Inquisizione ha l’incarico di detenere i registri delle interdizioni episcopali, arciepiscopali o concistoriali emesse. L’iscrizione nel registro garantisce il riconoscimento universale del provvedimento di interdizione. A tal fine, l’Autorità ecclesiastica procedente deve comunicare l’emissione di provvedimenti alla Santa Inquisizione.

    Articolo 7.9 Sono riservati alla Giustizia Straordinaria e dunque all'Inquisizione i casi di riconoscimento di persona e di riconoscimento di cadaveri.


Dei poteri specifici dell’Inquisizione

    Articolo 8.1 La Santa Inquisizione nelle more delle indagini può emettere provvedimenti cautelativi o di sospensione dagli incarichi ecclesiastici avverso le parti in causa.

    Articolo 8.2 Un chierico sotto giudizio è sospeso, dal tribunale procedente, dai suoi incarichi.

    Articolo 8.3 La Santa Inquisizione può comunicare informazioni e notizie ad ogni Autorità ecclesiastica a cui ritiene sia necessario. Collabora con le varie autorità in caso di indagini ed approfondimenti.

    Articolo 8.4 La Santa Inquisizione può avocare a sè un caso o una questione attinente, anche indirettamente, la Giustizia della Chiesa ed escludere ogni altra autorità ecclesiastica e non, ad eccezione del Santo Padre e del Sacro Collegio.

5.4: Die Kongregation der Heiligen Inquisition



Präambel

    Das Ziel der Heiligen Inquisition ist es den Sieg des wahren Glaubens durch die stete Verfolgung aller Arten von Häresie zu garantieren. Ihr Hauptziel ist es die Wiedereinsetzung von verlorenen Gläubigen in der Aristotelischen Gemeinschaft zu gewährleisten. Sie ist für die aristotelische Freundschaft in der Kongregation desselben Namens aktiv.



Hierarchie in der Kongregation der Heiligen Inquistion

    Artikel 1.1 Die Hierarchie besteht wie folgt:
    Kanzler der Kongregation der Heiligen Inquisition, auch bekannt als der Großinquisitor Major.
    Vizekanzler der Kongregation der Heiligen Inquisition, auch bekannt als Großinquisitor.
    Lokaler Kardinalinquisitor
    Zweiter, dritter, ..., lokaler Karindalinquisitor
    Präfekt
    Vizepräfekt
    Missi Inquisitionis und Episcopaler Generalstaatsanwalt.


Leiter der Kongregation und des Obersten Rates

    Artikel 2.1 Die Kongregation der Heiligen Inquisition wird vom Kanzler und Vizekanzler geleitet: Sie sind römische Elektorkardinäle, welche für diesen Zweck von ihren Kollegen aus der Versammlung der Kurie benannt werden.

    Artikel 2.2 Der Vizekanzler übt substitutive Macht aus, hat die gleichen Rechte, Verantwortungen und Vorrechte die dem Kanzler hierfür vorbehalten sind, so notwendig. Der Begriff Kanzler bezeichnet ebenso die Vorrechte des Vizekanzlers.

    Artikel 2.3 Der Kanzler kann Gebrauch von der Zusammenarbeit der Kardinalinquisitoren machen, die unter den Kardinälen jeder geodogmatischen Zone gewählt wurden, aus der sie ernannt und entlassen werden können. Diese Kardinäle sind verantwortlich für die Inquisition in ihrer eigenen geodogmatischen Zone und bilden eine lokale Heilige Inquisition.

    Artikel 2.4 Der Kanzler, der Vizekanzler und die Kardinalinquisitoren bilden den Hohen Rat. Der Rat ist das Instrument, das von den Leitern der Kongregation genutzt wird, um die Arbeit zu koordinieren und überwachen. Der darüber stehende Rat ist ein Ort der sich der Definition von Verteidigungsstrategien gegen Häresien und der Jagd auf die Kreatur ohne Namen verschrieben hat um den wahren Glauben obsiegen zu lassen.

    Artikel 2.5 Der lokale Kardinalinquisitor ist verantwortlich für die Vorbereitung der verfahrensrechtlichen Aufgaben der Missi Inquisitionis, die episkopalen Staatsanwälte zu entlassen und sofern sie spezifisch bevollmächtigt wurden, die Ernennung und Entlassung des episkopalen Generalstaatsanwaltes.


Präfekt der Heiligen Inquisition

    Artikel 3.1 Jede lokale Heilige Inquisition kann von der Zusammenarbeit eines Präfekten und möglicherweise eines oder mehrerer Vizepräfekten Gebrauch machen. Diese Beamten werden vom Kanzler nach Rücksprache mit dem lokalen Kardinalinquisitor ernannt. Der Präfekt unterliegt fachlich dem zugehörigen Kardinalinquisitor.

    Artikel 3.2 Im Falle der Vakanz der Position des lokalen Kardinalinquisitor, kann der Präfekt vom Hohen Rat als Abschlussprüfer benannt werden, jedoch hat er keine Entscheidungsgewalt solange sie nicht schnellstens erfragt oder delegiert wurde.

    Artikel 3.3 Jeder Missus Inquisitionis kann die Aufgabe des Präfekten erfüllen. Sofern möglich wird ein Missus der die Priesterweihe empfangen hat bevorzugt eingestellt.

    Artikel 3.4 Der Präfekt kooperiert mit dem lokalen Kardinalinquisitor um gute Zusammenarbeit in der Heiligen Inquisition zu erreichen, dabei beaufsichtigt er besonders die episkopalen und archiepiskopalen Gerichtshöfe.


Status des Missus Inquisitionis

    Artikel 4.1 Der Missus Inquisitionis ist ein Beamter der Inquisition, welcher der Aufgabe der Kongregation zur Verfügung steht.

    Artikel 4.2 Jeder aristotelische Kleriker, der ein spezielles Seminar, das die Kongregation der Inquisition organisiert hat, welches die legalen und rednerischen Qualitäten jedes Bewerbers garantiert, erfolgreich absolviert, kann die Zulassung in den Status als Missus Inquisitionis erlangen.

    Artikel 4.3 Der Missus Inquisitionis wird frei vom Kanzler der Heiligen Inquisition ernannt und entlassen, nachdem der lokale Kardinalinquisitor konsultiert wurde.

    Artikel 4.4 Der Missus Inquisitionis kann in der Ausübung seiner Pflichten von einem Laien seiner Wahl, mit aristotelischer Konfession, unterstützt werden solange der lokale Kardinalinquisitor dies authorisiert.

    Artikel 4.5 Dem Missus Inquisitionis ist es erlaubt die heraldischen Insignien der Inquisition zu nutzen.


Vom episkopalen Generalstaatsanwalt

    Artikel 5.1 Der episkopale Generalstaatsanwalt (EGS) wird durch den Kanzler der Kongregation der Heiligen Inquistition ernannt und entlassen. Das Vorrecht zu ernennen und zu entlassen kann spezifisch zum lokalen Kardinalinquisitor delegiert werden.

    Artikel 5.2 Es gibt nur einen EGS für jede geodogmatische Zone, die unter einer einzigen episkopalen Versammlung steht.

    Artikel 5.3 Wenn er ernannt ist, wird der EGS mit einer oder mehreren Pflichten betraut, so wie es in seiner Urkunde steht. Das Ernennungsdekret muss den Artikel des Statutes wählen, der seine Pflichten und Aufgaben anordnet. Der Kanzler kann ihn mit weiteren Aufgaben betrauen so lange sie sich nicht nachteilig auf die Vorrechte anderer Mitglieder der Kongregation auswirken.

    Artikel 5.4 Der EGS ist zuständig für die Bewerkstelligung, Unabhängigkeit und die nationalen Offizialate unter seiner Verantwortung. Er organisiert ebenfalls Termine und Widerrufe seiner Kompetenzen, sowie die notwendigen Handlungen, als auch den geeigneten Verlauf der ordentlichen Justiz die den episkopalen Offizialaten und archiepiskopalen Statute zuordnet.

    Artikel 5.5 Der EGS kann die Arbeit der individuellen episkopalen Bevollmächtigten unter seiner Juristdiktion koordinieren und überwachen. In diesem Falle ist es ihr hierarchischer Vorgesetzter.

    Artikel 5.6 Wenn es keinen episkopalen Staatsanwalt gibt, kann der ESG ihn als Staatsanwalt ersetzen und mit dem Bischof oder Erzbischof am episkopalen oder archiepiskopalen Gericht zusammenarbeiten.


Von der Geheimhaltung

    Artikel 6.1 Alle Mitglieder der Kongregation sind an die Geheimhaltung als Teil ihrer Pflichten gebunden.

    Artikel 6.2 Wer immer die Geheimhaltung der Inquisition verletzt, wird zusätzlich zu dem Urteil und der Bestrafung die verhängt werden, mit einem ewigen inquisitorischen Interdiktum belegt, das nur vom Kanzler der Heiligen Inquisition erlassen werden kann.


Der Auftrag der Inquisition

    Artikel 7.1 Die Heilige Inquisition muss in allen Fällen den Befehl geben, dass alle bekannten Gläubigen die ihren Weg verloren haben dem falschen Glauben abschwören, unabhängig von jeder anderen Überlegung. Die Heilige Inquisition hat als seine Hauptwaffe das Wort. Die Heilige Inquisition verwaltet die Justiz der Kirche in all ihren Formen.

    Artikel 7.2 Die Heilige Inquisition besitzt, wie es im Kanonischen Recht speziell definiert wird, die Leitung der direkten Administration der außerordentlichen Justiz. Sie beaufsichtigt die Homogenität in der ekklesialen Jurisdiktion. Insbesondere ist sie verantwortlich für die Beantwortung von Interpretationsfragen und der Anwendung des Kanonischen Rechtes oder sekundärer Vorschriften (Statuten der episkopalen Versammlungen, interne Vorschriften etc. ...).
    Sie überwacht den reibungslosen Ablauf aller Tätigkeiten die von der Heiligen Aristotelischen Kirche vorgeschrieben oder normiert sind.

    Artikel 7.3 Die Heilige Inquisition besitzt an allen Gerichten, welche zur Inquisition gehören, die Leitung über die Gewährleistung von gerechter Verwaltung der ordentlichen Rechtsprechung der Kirche. Sie hat die Macht die episkopalen Tribunale, die Justizvollzugsanstalten, die Römische Rota und das päpstliche Gericht zu kontrollieren und zu koordinieren. Sie kann als Ersatz herangezogen werden, wenn diese Gerichte nicht in der Lage sind zu handeln. Ihre Aufgabe ist es die Klerus- und Staatsanwaltsausbildung, sowie alle mit der Kongregation verbundenen Gebilden zu organisieren.

    Artikel 7.4 Um die perfekte Unabhängigkeit des Gerichtes der Justiz der Kirche durch den Kanzler der Heiligen Inquisition zu gewährleisten kann er zeitweise juristische Mitglieder, oder Personen die anderweitig dem Gericht angehören, ersetzen, welche den Fall in vorherigen Instanzen bearbeitet haben.

    Artikel 7.5 Sie unterstützt die Episkopale bei seinen Verhandlungen, durch seine zeitliche Macht episkopale Tribunale zu bilden. Sie arbeiten zusammen und unterschreiben Vereinbarungen (in Übereinstimmung mit der Nuntiatur) für juristische Kooperationen im generellen sowie im spezifischen Gebrauch an den IG Gerichten und Beantragung von Strafen durch die säkulare Justiz.

    Artikel 7.6 Die Heilige Inquisition beschäftigt eine Polizei innerhalb der Aristotelischen Kirche. Sie hat ein Mandat um Fehler zu prüfen, die durch Mitglieder des Klerus in Ausübung ihrer geistlichen Ämter begangen wurden. Sie kann die Resultate ihrer Ermittlungen dem apostolischen Strafvollzug übermitteln und disziplinarische Sanktionen empfehlen oder auf einen offenes Vorgehen drängen.

    Artikel 7.7 Die Heilige Inquisition leitet die informationsgebenden Dienste der Aristotelischen Kirche. In dieser Hinsicht hat sie die generelle Macht zur Ermittlung. Sie ist autorisiert jeden Fall oder jedes Individuum welches von Interesse erscheint zu untersuchen, dabei muss sie sorgfältig sein damit sie die gute und ordentliche Verwaltung der geistlichen oder weltlichen Justiz nicht stört.

    Artikel 7.8 Die Heilige Inquisition hat die Aufgabe die Akten der episkopalen, archiepiskopalen oder konsistorisch erlassenen Verbote aufzubewahren. Die Eintragung in die Register gewährleistet eine universelle Wiedererkennung von untersagten Maßnahmen. Zu diesem Zweck muss die betroffene ekklesiale Autorität die notierten Maßnahmen der Heiligen Inquisition bekannt geben.

    Artikel 7.9 Fälle der Wiedererkennung einer Person und der Identifizierung von Leichen sind der außerordentlichen Justiz und somit der Heiligen Inquisition vorbehalten.


Spezifische Kompetenzen der Inquisition

    Artikel 8.1 Die Heilige Inquisition kann in anhängigen Verfahren vorbeugende Maßnahmen der Suspendierung von Offizien der Kirche gegen involvierte Parteien verhängen.

    Artikel 8.2 Ein Kleriker, der vor Gericht steht, wird während des Verfahrens von seinen Pflichten entbunden.

    Artikel 8.3 Die Heilige Inquisition kann Informationen und Neuigkeiten an jede kirchliche Autorität weiter geben, an die es notwendig ist. Sie arbeitet im Falle von Untersuchungen und Einschätzungenen mit verschiedenen Autoritäten zusammen.

    Artikel 8.4 Die Heilige Inquisition kann einen Fall oder eine damit verbundene Angelegenheit, auch indirekt zur Justiz der Kirche zuordnen, für sich beanspruchen, und jede andere Autorität ausschließen, ausgenommen den Heiligen Vater und das Heiligen Kollegium.
