    Book 4 : The Church Justice




    Part I : Generalities and competences


    Generalities

    Article 1 : The Church Justice is administered by the Congregation of the Holy Inquisition, a Roman dicastery administered by a Cardinal-Chancellor Grand Inquisitor.

    Article 2 : The Church justice is a general component of the justice of the kingdoms and therefore also responds to the moral imperatives of the kingdom, [„The Judge's Charter“], taking into account however, its place and mission.

    Competences

    Article 3 : The Church Justice is competent in all violations of the Dogma, doctrines and the Canon Law of the Aristotelian Universal and Roman Church. It pronounces on the orthodoxy of the acts that it is brought to judge.

    Article 4 : The jurisdiction of Church Justice extends as far as the shadow of Aristotle and can be exercised on all the parishes of the known Lands.

    Article 5 : Any individual may, except as otherwise provided by the competent authorities, be a complainant, an accused or a witness.

    Article 6 : In the articulation of the sources of law, the Justice of the Church draws its sources, in the order, each cited source prevailling on the following one:
    - The Aristotelian Dogma,
    - The Doctrines,
    - The Canon Law,
    - Agreemens, treaties or concordats validated by the competent authorities of the Church,
    - Jurispudential custom,
    - of use

    Jurisdictions and resort

    Article 7 : Church Justice includes an Ordinary Justice and a Justice of Exception also called „Extraordinary“.

    Article 8 :Church Justic has six courts :
    - Archiepiscopal or National Officiality,
    - The Apostolic Penitentiary,
    - The Tribunal of the Inquisition,
    - The Roman Rotary Court,
    - The Court of the Apostolic Signature,
    - The Tribunal Pontifical.

    Article 9 : The Ordinary Justice is redered in first instance, for the faithful, by the Archiepiscopal or National Officiality;for clerics, by the Apostolic Penitentiary. Ordinary Justice is redered second-rate for the faithful and the clergy by the Roman Rota.

    Article 10 : Exceptional Justice is rendered in first instance by the Inquisition Tribunal and secondarily by the Supreme Tribunal of the Apostolic Signature.

    Article 11 : The cardinals, whatever their nature or status, depend exclusively, for ordinary justice in first and only instance, on the Pontifical Tribunal; for the Justice of Exception, in first and sole instance, of the Supreme Tribunal of the Apostolic Signature.
