ESTATUTOS DA ASSEMBLÉIA EPISCOPAL DE PORTUGAL
Nós, Prelados do Reino de Portugal, reunidos em Colégio, sob os auspícios e orientação de Jah, Aristóteles e Christos, com a finalidade de prover novos regramentos que estejam de acordo com o atual Direito Canônico, decidimos e dispomos, em ato definitivo, sobre a aprovação dos novos Estatutos da Assembleia Episcopal de Portugal.
CAPÍTULO I - DAS DISPOSIÇÕES GERAIS
Art. 1.° - A Assembleia Episcopal de Portugal ou "AEP", com sede no Palácio Episcopal de São Jorge, Lisboa, Portugal, e jurisdição em toda zona geodogmática lusófona, em conformidade com o Direito Canônico, tem por missão garantir a governabilidade e o bom funcionamento de todas as províncias eclesiásticas concernentes em sua jurisdição.
Art. 2.° - A Assembleia Episcopal de Portugal reconhece e se submete à autoridade espiritual de Sua Santidade o Papa, ao Consistório Pontifical Lusófono e ao Sagrado Colégio de Cardeais.
Art. 3.° - A Assembleia Episcopal de Portugal é o órgão deliberativo superior hierárquico de todo clero português.
Art. 4.° - Todas as deliberações da Assembleia Episcopal de Portugal são tomadas em colegiado, em conformidade com o Direito Canônico e as Leis da Santa Madre Igreja, dispondo de efeito imediato sobre todo o clero português.
CAPÍTULO II - DA COMPOSIÇÃO
Art. 5.° - A Assembleia Episcopal de Portugal é composta por três classes de membros: os membros de direito, os membros honorários e os membros cooptados;
Art. 6.° - São membros de direito, todos àqueles com direito à voz e voto do plenário da AEP. São eles:
I – O Primaz;
II – O Vice-Primaz;
III – Os Bispos e Arcebispos In Gratebus;
IV – Os Bispos e Arcebispos In Partibus;
V – Os Bispos e Arcebispos Eméritos;
VI – Os Bispos e Arcebispos Sine Cura;
Art. 7° - São membros honorários todos àqueles com direito unicamente à palavra no plenário da AEP. São eles:
I – O Reitor do Seminário Menor de Viana do Castelo;
II – Os Cardeais Residentes no Reino de Portugal, e
III – O Secretário Apostólico Português da Nunciatura Romana.
Art. 8.° - Entende-se por membros cooptados todos aqueles que integram a Assembleia, pro decisão do colegiado, para prestar auxílio geral ou específico à determinado assunto.
Parágrafo Único: A duração do assento do membro cooptado, bem como os limites do direito de participação nas discussões, se houver, serão discutidos e votados no momento da cooptação.
CAPÍTULO III - DO FUNCIONAMENTO DO PLENÁRIO DA AEP
Art. 9.° - Todos os membros, com exceção dos membros cooptados, poderão propor temas à serem discutidos no plenário da AEP, que deliberará sob a Presidência do Primaz de Portugal.
Art. 10 - As discussões em plenário devem ser debatidas em um prazo mínimo de 48 (quarenta e oito) horas, podendo o prazo da discussão ser dilatado à critério do Primaz ou o proponente da discussão.
Art. 11 - As votações terão duração pelo período de 48 (quarenta e oito) horas ou até todos os membros de direito votarem.
Parágrafo Único: Todas as votações terão, obrigatoriamente, a opção "Em branco".
Art. 12 - Admite-se, no plenário da AEP, a Decisão por Consenso, caso ocorra unanimidade de concordância dos membros no assunto em debate.
Art. 13 - Pode o Primaz declarar "inativo" todos os membros que não participarem de qualquer votação no plenário, sendo, por consequência, excluído da contabilização do quórum mínimo para aprovação das decisões.
Parágrafo Único: o status de "inativo" permanecerá até que o membro inativo exerça seu direito de voto em uma votação posterior.
Art. 14 - Os votos depositados nas urnas são secretos e inalteráveis.
Art. 15 - A critério do Primaz, pode uma discussão receber o caráter de "Discussão de Urgência", de modo que o prazo mínimo para discussão e votação serão reduzidos para o prazo de 24 (vinte e quatro) horas.
Art. 16 - Em caso de empate, o Primaz tem direito ao Voto de desempate. O Voto de desempate deve ser declarado.
CAPÍTULO IV - DO PRIMAZ E DO VICE-PRIMAZ DE PORTUGAL
Art. 17 - O Primaz de Portugal é o Chefe da Igreja no Reino de Portugal e a representa perante o Consistório Pontifical Lusófono, sendo eleito pelos membros da Assembleia Episcopal de Portugal.
Art. 18 - Compete ao Primaz:
I - Presidir a Assembleia Episcopal de Portugal, ordenando-lhe a atuação;
II - Representar a Igreja Aristotélica Portuguesa em âmbito nacional ou Internacional;
III - Garantir o respeito ao Dogma, ao Direito Canônico, à estes estatutos e às diretrizes estabelecidas pela Assembléia Episcopal de Portugal;
IV - Editar Decretos e decisões para regulamentar situações em caráter de urgência, desde que não contrários ao Dogma, ao Direito Canônico e às decisões do Consistório Pontifical Lusófono;
V - Vetar parcial ou totalmente as decisões da AEP, fundamentando justificadamente as razões do veto que, posteriormente, poderão ser derrubadas por nova decisão da AEP;
VI - Nomear o Vice-Primaz de Portugal, e
VII - Exercer outras funções que lhe sejam delegadas.
Parágrafo Único: Todas as decisões unilaterais do Primaz, poderão se revistas e revogadas posteriormente pela Assembleia Episcopal de Portugal.
Art. 19 - O Primaz é eleito para um mandato de 6 (seis) meses, dentre membros da Assembleia Episcopal de Portugal que sejam Bispos ou Arcebispos pelo período mínimo de 3 (três) meses, seguindo os seguintes procedimentos:
I - Quando faltar 10 (dez) dias para o fim de seu mandato, o atual Primaz anunciará a abertura das candidaturas, nos termos deste Estatuto e das Regras do Direito Canônico, pelo prazo de 5 (cinco) dias;
II - As candidaturas deverão ser precedidas da entrega do currículo do candidato, nos moldes romanos;
III - Decorrido o período de candidaturas, os membros da Assembleia Episcopal de Portugal deliberarão sobre os candidatos durante o período de 3 (três) dias;
IV - Terminado o prazo de discussão, o atual Primaz iniciará o período de votação, pelo prazo de 2 (dois) dias, e
V - Decorrido o prazo, o Primaz contabilizará os votos e anunciará a eleição do novo Primaz.
Art. 20 - O Vice-Primaz é o auxiliar direto do Primaz e segundo prelado na hierarquia da Igreja Nacional, competindo-lhe, dentre outras funções:
I - Auxiliar o Primaz de Portugal em todas as suas funções;
II - Assumir a Primazia da Igreja nos casos de ausência, desaparecimento ou demissão do Primaz, cumprindo o restante do tempo do mandato, e
III - Cuidar da execução dos procedimentos para a eleição do novo Primaz, em caso de demissão ou inércia do atual Primaz.
CAPÍTULO V - DAS PROVÍNCIAS ECLESIÁSTICAS PORTUGUESAS E DO EPISCOPADO
SEÇÃO I - DAS PROVÍNCIAS ECLESIÁSTICAS PORTUGUESAS
Art. 21 - A Zona Geodogmática Portuguesa está dividida em três províncias, quais sejam:
I - A Província Metropolitana de Braga;
II - A Província Metropolitana de Lisboa, e
III - A Província Metropolitana de Évora.
Art. 21 - A Província Metropolitana de Braga é presidida pelo Arcebispo Metropolitano de Braga e compreende a Arquidiocese Metropolitana de Braga e a Diocese Sufragânea de Coimbra.
Art. 22 - A Província Metropolitana de Lisboa é presidida pelo Arcebispo Metropolitano de Lisboa e compreende a Arquidiocese Metropolitana de Lisboa e a Diocese Sufragânea de Guarda.
Art. 23 - A Província Metropolitana de Évora é presidida pelo Arcebispo Metropolitano de Braga e compreende a Arquidiocese Metropolitana de Évora sem qualquer Diocese Sufragânea.
SEÇÃO II - DOS ARCEBISPOS METROPOLITANOS E DOS BISPOS SUFRAGÂNEOS
Art. 23 - Os Arcebispos Metropolitanos e os Bispos Sufragâneos, cujas atribuições e prerrogativas são disciplinadas pelo Direito Canônico, são nomeados pelo Santo Padre e indicados pela Assembleia Episcopal de Portugal.
Art. 24 - Em relação à Igreja Nacional, competem aos Arcebispos Metropolitanos e Bispos Sufragâneos:
I - Informar a Assembleia Episcopal de Portugal sobre a formação de seus Conselhos, bem como mantê-la atualizada sobre as eleições paroquiais, e
II - Apresentar, quando requerido pelo Primaz ou pelo colegiado, Relatório sobre o Estado da Arquidiocese Metropolitana ou Diocese Sufragânea.
SEÇÃO III - DOS ADMINISTRADORES DIOCESANOS
Art. 25 - Quando se fizer necessário, a Assembleia Episcopal de Portugal pode eleger Administradores Diocesanos InGratebus, na forma do Direito Canônico, que exercerão seu ofício sob a orientação do Arcebispo Metropolitano ou Bispo Diocesano nomeados ResParendum.
SEÇÃO IV - DOS ARCEBISPOS E BISPOS EMÉRITOS
Art. 26 - Todo Arcebispo Metropolitano e Bispo Sufragâneo que exercer a função pelo período de 8 (oito) meses consecutivos, recebe o título de Arcebispo ou Bispo Emérito de suas respectivas Arquidioceses ou Dioceses.
Parágrafo Primeiro: O título de Arcebispo ou Bispo Emérito possui validade de 8 (oito) meses.
Parágrafo Segundo: O título de Emérito será automaticamente revogado nas hipóteses em que o prelado assuma a gestão de uma Arquidiocese ou Diocese InGratebus.
SEÇÃO V - DOS BISPOS IN PARTIBUS
Art. 27 - Os Bispos In Partibus são nomeados pelo Sagrado Colégio de Cardeais dentre sacerdotes cujos feitos foram considerados notáveis para a construção, divulgação e melhoramento da fé aristotélica.
Parágrafo Único: É facultada a Assembleia Episcopal de Portugal indicar ao Sagrado Colégio de Cardeais o nome de um Sacerdote para receber o título de Bispo In Partibus.
Art. 28 - O título de Bispo In Partibus é vitalício, sendo revogado somente nas hipóteses da morte do prelado ou por Determinação do Sagrado Colégio de Cardeais.
Parágrafo Único: O título é temporariamente suspenso nos casos em que o prelado assuma a gestão de uma Arquidiocese ou Diocese In Gratebus.
SEÇÃO VI - DOS BISPOS SINE CURA
Art. 29 - Os Bispos Sine Cura são nomeados diretamente pelo Sumo Pontífice para o auxílio na obra da Santa Madre Igreja.
Art. 30 - O título de Bispo Sine Cura é vitalício, sendo revogado somente nas hipóteses da morte do prelado ou por Determinação do Sagrado Colégio de Cardeais.
CAPÍTULO VI - DAS DISPOSIÇÕES FINAIS
Art. 31 - Estes Estatutos entram em vigor à partir da data de sua publicação, revogando todas as disposições em contrário.
Estatutos aprovados pela Assembléia Episcopal de Portugal, aos XXII dias do mês de Junho do ano da Graça de Nosso Senhor de MCDLXVII. Primeiro do Pontificado de Sua Santidade Sixtus IV.

Estimados infelizmente me foi impossível comparecer aqui antes do fechamento da urna, ainda assim, gostaria de manifestar meu voto o qual já encaminhei em privado ao nosso Vice Primaz a quem novamente agradeço por estar levando adiante estes assuntos em nossas ausências.

Não precisa agradecer, meu caro Primaz e amigo. Somos um time. Todos nós. E me orgulho de ver que, em Roma, a parceria que temos é tão escassa.
Não fecharíamos a votação sem a sua manifestação.

Os novos estatutos da AEP foram aprovados.
Encaminharei, como de praxe, ao Colégio de Cardeais para aprovação.

STATUTES OF PORTUGAL'S EPISCOPAL ASSEMBLY
We, the Prelates of the Kingdom of Portugal, gathered in College, under the auspices and guidance of Jah, Aristotle and Christos, with the purpose of providing new regulations in accordance with the current Canon Law, we decide and dispose, in definitive act, the approval of the new Statutes of Portugal's Episcopal Assembly, or AEP.
CHAPTER I - ABOUT GENERAL PROVISIONS
Art. 1.° - The Portugal's Episcopal Assembly or "AEP" (portuguese translation initials), with its headquarters in the Episcopal Palace of São Jorge, Lisboa, Portugal, and jurisdiction in all Portuguese-speaking geodogmatic zones, in accordance with Canon Law, has as its mission to guarantee the governance and proper functioning of all ecclesiastical provinces integred in your jurisdiction.
Art. 2.° - The Portugal's Episcopal Assembly recognizes and submits to the spiritual authority of His Holiness, the Pope, the Lusophone Pontifical Consistory and the Sacred College of Cardinals.
Art. 3.° - The Portugal's Episcopal Assembly is the superior deliberative organ of all Portuguese clergy.
Art. 4.° - All deliberations of Portugal's Episcopal Assembly are taken in collegiate, in accordance with the Canon Law and the Laws of the Holy Mother Church, having immediate effect on all the Portuguese clergy.
CHAPTER II - ABOUT THE COMPOSITION
Art. 5.° - The Portugal's Episcopal Assembly is composed by three classes of members: Rightfull members, honorary members and co-opted members;
Art. 6.° - The Rightfull Members are those with a voice inside the AEP and the right to vote in the plenary. They are:
I – The Primate;
II – The Vice Primate;
III – The Bishops and Archbishops In Gratebus;
IV – The Bishops and Archbishops In Partibus;
V – The Bishops and Archbishops Emeritus, and
VI – The Bishops and Archbishops Sine Cura.
Art. 7° - The Honorary Members are those with the right to speak in the plenary session of the AEP. They Are:
I – The Dean of the Minor Seminary of Viana do Castelo;
II – The Cardinals Residing in the Kingdom of Portugal, and
III – The Portuguese Apostolic Secretary of the Roman Nunciature.
Art. 8.° - It's an understandment that co-opted members are everyone who has a sit in the Assembly, by the decision of the collegiate, to help on a specific or general matter.
Single Paragraph: The right to a sit in the Assembly lasts as much time as decided by the collegiate in the moment of the cooption. The limits of this coopted member's participation, such as his rights, is also decided during the cooption.
CHAPTER III - ABOUT THE FUNCTIONING OF AEP'S PLENARY
Art. 9.° - All members, with the exception of co-opted members, may propose topics to be discussed in the plenary of the AEP, which will deliberate under the Presidency of the Primate of Portugal.
Art. 10 - All discussions in plenary should be debated in a minimum period of 48 (forty eight) hours. This period may be extended by the will of the Primate or the proponent.
Art. 11 - The voting period must last 48 (forty-eight) hours or until all members of the college have voted.
Single Paragraph: All poll must have the option "Blank".
Art. 12 - The Consensus Decision is accepted in the plenary session, in case there is unanimity of agreement of the members in the matter under discussion.
Art. 13 - The Primate may declare "inactive" all members who do not participate in any votation in the plenary and, therefore, are excluded from counting the minimum quorum for approval of decisions.
Single Paragraph: The status of "inactive" will remain until the inactive member exercises his right to vote in a future matter.
Art. 14 - The votes cast at the polls are secret and unalterable.
Art. 15 - By the Primate's will, a discussion may be consider emergencial - "Emergency Discussion" -, which means the minimum time for discussion and voting will be reduced to 24 (twenty four) hours.
Art. 16 - In case of a tie, the Primate is entitled to the tie-breaking vote. The tie-breaking vote must be declared.
CHAPTER IV - ABOUT THE PRIMATE AND VICE PRIMATE OF PORTUGAL
Art. 17 - The Primate of Portugal is the Head of the Church in the Kingdom of Portugal, therefore it's representant in Consistory of the Pontifical Lusophone, being elected by the members of the Portugal's Episcopal Assembly.
Art. 18 - It's up to the Primate:
I - To preside over the Episcopal Assembly of Portugal, ordering it to act;
II - Represent the Portuguese Aristotelian Church nationally or internationally;
III - Ensure respect for the Dogma, the Canon Law, these statutes and the guidelines established by the Portuguese Bishops' Assembly;
IV - Edit Decrees and decisions to regulate situations in an urgent matter, provided they are not contrary to Dogma, Canon Law and the decisions of the Pontifical Lusophone Consistory;
V - The Partially or totally veto the decisions of the AEP, justifying justifiably the reasons for the veto, which may later be overturned by a new decision of the AEP;
VI - To appoint of the Vice-Primate of Portugal, e
VII - Carry out the other duties delegated to him.
Single Paragraph: All unilateral decisions of the Primate may be revised and later revoked by Portugal's Episcopal Assembly.
Art. 19 - The Primate is elected for a term of 6 (six) months, among members of the Portugal's Episcopal Assembly who are Bishops or Archbishops for a minimum period of 3 (three) months, following the following procedures:
I - When there is 10 (ten) days to the end of his term, the current Primate will announce the opening of the candidatures, in accordance with these Statutes and the Canon Law's rules, for a period of 5 (five) days;
II - Applications must be preceded by the delivery of the CV of the candidate, in the Roman format;
III - After the candidature period, the members of the Portugal's Episcopal Assembly will deliberate on the candidates during the period of 3 (three) days;
IV - After the discussion period, the current Primate will begin the voting period, for a period of 2 (two) days, and
V - Upon expiration of the term, the Primate shall count the votes and announce the election of the new Primate.
Art. 20 - The Vice-Primate is the direct auxiliary of the Primate and second prelate in the hierarchy of the National Church, competing to him, among other functions:
I - To assist the Primate of Portugal in all his functions;
II - Assume the primacy of the Church in cases of absence, disappearance or dismissal of the Primate, fulfilling the remainder of the mandate, and
III - To take care of the execution of the procedures for the election of the new Primate, in case of dismissal or inertia of the current Primate.
CHAPTER V - ABOUT THE PORTUGUESE ECCLESIASTICAL PROVINCES AND TO EPISCOPATE
SECTION I - ABOUT THE PORTUGUESE ECCLESIASTICAL PROVINCES
Art. 21 - The Portuguese Geodogmatic Zone is divided into three provinces, which are:
I - The Metropolitan Province of Braga;
II - The Metropolitan Province of Lisboa, and
III - The Metropolitan Province of Evora.
Art. 21 - The Metropolitan Province of Braga is presided over by the Metropolitan Archbishop of Braga and comprises the Metropolitan Archdiocese of Braga and the Suffragan Diocese of Coimbra.
Art. 22 - he Metropolitan Province of Lisboa is presided over by the Metropolitan Archbishop of Lisboa and comprises the Metropolitan Archdiocese of Lisboa and the Suffragan Diocese of Guarda.
Art. 23 - The Metropolitan Province of Évora is presided over by the Metropolitan Archbishop of Évora and comprises the Metropolitan Archdiocese of Évora without any Suffragan Diocese.
SECTION II - ABOUT THE METROPOLITAN ARCHBISHOPS AND SUFFRAGAN BISHOPS
Art. 23 - The Metropolitan Archbishops and Suffragan Bishops, whose duties and prerogatives are governed by Canon Law, are appointed by the Holy Father and indicated by the Portugal's Episcopal Assembly.
Art. 24 - In relation to the National Church, the Metropolitan Archbishops and Suffragan Bishops:
I - To inform the Portugal's Episcopal Assembly about the formation of its Councils, as well as to keep it abreast of parish elections, and
II - To Present, when required by the Primate or by the collegiate, Report on the state of the Metropolitan Archdiocese or Suffragan Diocese.
SECTION III - ABOUT THE DIOCESAN ADMINISTRATORS
Art. 25 - When necessary, the Portugal's Episcopal Assembly may elect Diocesan Administrators InGratebus, in the form of Canon Law, who will exercise their office under the guidance of the Metropolitan Archbishop or Diocesan Bishop appointed ResParendum.
SECTION IV - ABOUT THE ARCHBISHOPS AND BISHOPS EMERITUS
Art. 26 - Every Metropolitan Archbishop and Suffragan Bishops who holds office for a period of 8 (eight) consecutive months, receives the title of Archbishop or Emeritus Bishop of his respective Archdioceses or Dioceses.
First Paragraph: The title of Archbishop or Bishop Emeritus is valid for 8 (eight) months.
Second Paragraph: The title of Emeritus will be automatically revocated in cases where the prelate takes over the management of an Archdiocese or Diocese InGratebus.
SECTION V - ABOUT THE BISHOPS IN PARTIBUS
Art. 27 - The Bishops In Partibus are appointed by the Sacred College of Cardinals among priests whose achievements were considered notable for the construction, dissemination and improvement of the Aristotelian faith.
Single Paragraph: It is possible for the Portugal's Episcopal Assembly to indicate to the Sacred College of Cardinals the name of a Priest to receive the title of Bishop In Partibus.
Art. 28 - The title of Bishop In Partibus is for lifelong, being revoked only in the hypothesis of the death of the prelate or by Determination of the Sacred College of Cardinals.
Single Paragraph: The title is temporarily suspended in cases in which the prelate assumes the management of an Archdiocese or Diocese In Gratebus.
SECTION VI - ABOUT THE BISHOP SINE CURA
Art. 29 - The Bishops Sine Cura are appointed directly by the Supreme Pontiff to assist in the work of the Holy Mother Church.
Art. 30 - The title of Bishop Sine Cura is for lifelong, being revocated only in the hypothesis of the death of the prelate or by Determination of the Sacred College of Cardinals.
CHAPTER VI - ABOUT THE FINAL PROVISIONS
Art. 31 - These Statutes shall enter into force as of the date of their publication, revocating all provisions to the contrary.
