    Statutes of the Primacy of the Holy Roman Empire


    In accordance with Book 2 Part I of the Codex Iuris Canonici of the Holy Aristotelian, Universal and Roman Church, called "Regimini secularis ecclesiae", the Primacy of the Holy Roman Empire is established, taking over and having authority over all the archdioceses, dioceses and parishes present in whole or in part in the lands of the SRING, Provence and Switzerland.

    The Primacy of the Holy Roman Empire is directed by the Episcopal Assembly of the Holy Roman Empire in accordance with and within the limits of Dogma, Canon Law and the higher authority of the Roman Curia and the other Institutions of the Holy Church.
    The Primacy of the Holy Roman Empire is divided, for purely organisational purposes, into five Vice-Primacies, each covering the Italian, German, French, Dutch and Slovenian language regions within the territory of the Primacy, and each having a permanent synod for the meetings and discussions of the local episcopate.

    As a territorial subdivision of the Holy Church, the Primacy of the Holy Roman Empire is naturally subject to the doctrinal and pastoral authority of the Holy See and its institutions.

    Part I. The Episcopal Assembly of the Holy Roman Empire


    I. Composition

    Article 1. The Episcopal Assembly of the Holy Roman Empire is composed of full members, consultative members and co-opted members.

    Article 2 The full members with the right to speak and vote are
    • The (arch)bishops of the Holy Roman Empire, i.e. those elected according to the canonical procedures of Res Parendo to govern a diocese;
    • The (arch)bishops In Partibus having their principal residence (In Gratebus) in the territory of the Holy Roman Empire;
    • The (arch)bishops emeritus having their principal residence (In Gratebus) in the territory of the Primacy of the Holy Roman Empire;
    • All Cardinals having their principal residence (In Gratebus) in the territory of the Holy Roman Empire;
    • The rectors of Roman religious orders having their principal residence (In Gratebus) in the territory of the Primacy of the Holy Roman Empire;
    • The Grand Masters of religious military orders having their principal residence (In Gratebus) in the territory of the Holy Roman Empire.


    Article 3 The consulting members with the right to speak but not to vote are:

    • All Cardinals having their principal residence (In Gratebus) outside the territory of the Holy Roman Empire;
    • A delegate of the Apostolic Nunciature, appointed by the latter for this purpose, provided that he is at least ordained or has the rank of a bishop;
    • A delegate of the Holy Armies, appointed by the latter for this purpose, provided that he is at least ordained or has the rank of a bishop.


    Article 4. The co-opted members, having only the right to speak, are appointed by the Episcopal Assembly of the Holy Roman Empire on the basis of their moral, intellectual and religious qualities and on the proposal of a full member.

    II. Functioning

    Article 5. Decisions are taken in consultations with the full members by a simple majority vote of those who vote.

    Article 6. All members can participate in the debates, but only full members can initiate a consultation and vote.

    Article 7. In the event of a tie, the Primate of the Holy Roman Empire has the casting vote.
    Article 8. The vote must always include the possibility of voting blank and the possibility of voting against. Blank votes therefore do not count.

    Article 9. The vote has an ordinary duration of five days and must always be preceded by a debate period of at least three days.

    Article 10. Voting may be initiated immediately and the voting period shortened to three days in agreement with the Primate, upon his decision or in cases provided for in the emergency procedures.
    Article 11. The following cases allow for the emergency procedure:
    • undeclared absence of the Primate and his Vice Primates for a fortnight;
    • armed conflict involving parishes in the Holy Roman Empire;
    • any debate on a subject which calls for a rapid reaction by the CESE upon a reasoned decision by the Primate.
      N.B. By absence is meant non-participation in the debates of the Episcopal Assembly of the Holy Roman Empire or spiritual retreat

    Article 13. The work of the Episcopal Assembly of the Holy Roman Empire takes place behind closed doors and is subject to secrecy; it is absolutely forbidden to divulge the content of this work to anyone outside the Episcopal Assembly of the Holy Roman Empire, except for the purpose of reporting to the Higher Institutions of the Holy See.


    Part II. The Bishoprics


    I. (Arch)Bishops

    Article 13. The Episcopal Assembly of the Holy Roman Empire appoints and dismisses the (arch)bishops of the Holy Roman Empire.

    Article 14. The following are grounds for dismissal:
    • absence for more than one month without justification or prior announcement
    • Interference in the affairs of another diocese in spite of the warnings of his superiors
    • indiscipline and obstinacy in the same, (the Episcopal Assembly of the Holy Roman Empire may be the judge of this point),
    • failure in his office according to the advice of the primate after investigation by him, which is to be presented to the Episcopal Assembly of the Holy Roman Empire.
    • Abandonment of his diocese without notice to the Primate.

      Article 14.1. Revocation takes place tacitly if a new (arch)bishop is appointed to head the same (arch)diocese.

    Article 15. The procedure for the election of a new (arch)bishop is usually initiated when a (arch)episcopal see becomes vacant.

    Article 16. The (arch)episcopal sees become vacant upon the death, resignation or dismissal of the competent (arch)bishop.

    Article 17. The Primate announces the vacancy of an (arch)episcopal see in Aristotle Square and in the public square of the (arch)diocesan territory and launches a five-day call for candidates.

    Article 18. Candidates should make themselves known to the Primate with a curriculum vitae, a degree in theology and a letter of motivation. The Primate may reject outlandish or unsuitable candidates, but must inform the Episcopal Assembly of the Holy Roman Empire..

    Article 19. The Primate collects the nominations and launches the vote as quickly as possible to ensure that the election takes place in the best possible conditions.

    II. Diocesan Administrators

    Article 20. The Episcopal Assembly of the Holy Roman Empire appoints the diocesan administrators of the Holy Roman Empire for a period of four months.

    Article 21. The following are grounds for dismissal:
    • absence for more than one month without justification or prior announcement
    • Interference in the spiritual affairs despite the warnings of his superiors
    • indiscipline and obstinacy therein, (the Episcopal Assembly of the Holy Roman Empire may be the judge of this point),
    • failure in office according to the advice of the primate after investigation by him, which is to be presented to the Episcopal Assembly of the Holy Roman Empire.


    Article 22. The procedure for the election of a diocesan administrator is initiated when an (arch)bishopric of the Holy Roman Empire is without an (arch)bishop or if he cannot guarantee the administration In Gratibus.

    Article 23. The Primate issues a five-day call for applications, specifying whether the position is sede plena or sede vacante, i.e. whether there is an (arch)bishop Res Parendo or not.

    Article 24. Candidates should make themselves known to the Primate with a curriculum vitae, any diplomas obtained, their status as a pastor of the faith and a letter of motivation. The Primate may reject outlandish or unsuitable candidates, but must report this to the Episcopal Assembly of the Holy Roman Empire.

    Article 25. The Primate collects the nominations and launches the vote as quickly as possible to ensure that the election takes place in good conditions..


    Part III. The Primate of the Holy Roman Empire


    Article 26. The Primate represents the Primacy of the Holy Roman Empire and presides over the Episcopal Assembly of the Holy Roman Empire. He is responsible for ensuring compliance with the Statutes and guidelines established by the Episcopal Assembly of the Holy Roman Empire.

    Article 27. The Primate is elected from among the full members of the Episcopal Assembly of the Holy Roman Empire for a renewable term of 6 months.

    Article 28 All candidates for the Primacy will be required to provide a full curriculum vitae and a programme.

    Article 29. The Primate appoints a Vice Primate for each Vice Primacy to assist him in his duties. He may choose and dismiss them as he sees fit, provided they reside in the Vice Primacy assigned to them.

    Article 30. When appointing Vice Primates, the Primate shall establish the order of priority among them for the sole purpose of transition of primate powers.

    Article 31. In the event of an unannounced absence of more than fourteen days, the Primate is replaced by a Vice Primate according to the order of priority established at the time of appointment. The vice-primate then obtains all the powers vested in the Primate until the latter's return.

    Article 32. The Primate and his Vice Primates shall take care to announce their absences in order to allow the smooth running of the Episcopal Assembly of the Holy Roman Empire.

    Article 33. The Primate has a tacit and permanent mandate which gives him all the powers of the Episcopal Assembly of the Holy Roman Empire. He can therefore issue decrees unilaterally. These decrees can in turn be annulled by the Episcopal Assembly of the Holy Roman Empire, the annulment procedure having a suspensive effect.

    Article 34 The Primate may be removed from office by the Episcopal Assembly of the Holy Roman Empire by a sufficiently motivated motion of censure.

    Article 35. In the event of the death, removal or absence of more than one month of the Primate, a Vice Primate, according to the order of priority established at the time of appointment, is responsible for the transition to a new primatial election.

    Gemäß Buch 2 Teil I des Codex Iuris Canonici der Heiligen Aristotelischen, Universalen und Römischen Kirche, genannt "Regimini secularis ecclesiae", wird das Primat des Heiligen Römischen Reiches errichtet, das alle Erzdiözesen, Diözesen und Pfarreien, die sich ganz oder teilweise in den Ländern der SRING, der Provence und der Schweiz befinden, umfasst und über sie die Autorität ausübt.

    Das Primat des Heiligen Römischen Reiches wird von der Episkopalversammlung des Heiligen Römischen Reiches in Übereinstimmung mit und innerhalb der Grenzen des Dogmas, des Kirchenrechts und der höheren Autorität der Römischen Kurie und der anderen Institutionen der Heiligen Kirche geleitet.
    Das Primat des Heiligen Römischen Reiches ist aus rein organisatorischen Gründen in fünf Vizeprimate unterteilt, die jeweils die italienischen, deutschen, französischen, niederländischen und slowenischen Sprachgebiete innerhalb des Territoriums des Primats abdecken und jeweils über eine ständige Synode für die Sitzungen und Beratungen des örtlichen Episkopats verfügen.

    Als territoriale Untergliederung der Heiligen Kirche untersteht das Primat des Heiligen Römischen Reiches natürlich der lehrmäßigen und pastoralen Autorität des Heiligen Stuhls und seiner Institutionen.

    • Die Großmeister der religiösen Militärorden, die ihren Hauptsitz (In Gratebus) auf dem Gebiet des Heiligen Römischen Reiches haben.


    Article 3 Die beratenden Mitglieder mit Rederecht, aber ohne Stimmrecht sind:

    • Alle Kardinäle, die ihren Hauptwohnsitz (In Gratebus) außerhalb des Heiligen Römischen Reiches haben;
    • Ein Delegierter der Apostolischen Nuntiatur, der von dieser zu diesem Zweck ernannt wird, vorausgesetzt, er ist zumindest geweiht oder hat den Rang eines Bischofs;
    • Ein Delegierter der Heiligen Armeen, der von diesen zu diesem Zweck ernannt wird, vorausgesetzt, er ist mindestens geweiht oder hat den Rang eines Bischofs.


    Article 4. Die kooptierten Mitglieder, die nur über ein Rederecht verfügen, werden von der Episkopalversammlung des Heiligen Römischen Reiches auf der Grundlage ihrer moralischen, intellektuellen und religiösen Qualitäten und auf Vorschlag eines Vollmitglieds ernannt.

    II. Funktionsweise

    Article 5. Die Beschlüsse werden nach Konsultation der Vollmitglieder mit einfacher Mehrheit der Stimmberechtigten gefasst.

    Article 6. Alle Mitglieder können an den Debatten teilnehmen, aber nur Vollmitglieder können eine Konsultation einleiten und abstimmen.

    Article 7. Bei Stimmengleichheit gibt die Stimme des Primas des Heiligen Römischen Reiches den Ausschlag.
    Article 8. Bei der Abstimmung muss immer die Möglichkeit bestehen, mit leeren Stimmzetteln zu stimmen, und die Möglichkeit, mit Nein zu stimmen. Leere Stimmen werden demnach nicht gezählt.
    Article 9. Die Abstimmung dauert in der Regel fünf Tage, und ihr muss immer eine mindestens dreitägige Debatte vorausgehen..

    Article 10. Im Einvernehmen mit dem Primas, auf dessen Beschluss oder in den in den Dringlichkeitsverfahren vorgesehenen Fällen kann die Abstimmung sofort eingeleitet und die Abstimmungsfrist auf drei Tage verkürzt werden.
    Article 11. In den folgenden Fällen kann das Notfallverfahren angewendet werden:
    • unerklärte Abwesenheit des Primas und seiner Vizeprimasse für zwei Wochen;
    • bewaffnete Konflikte, an denen Pfarreien im Heiligen Römischen Reich beteiligt waren;
    • jede Debatte über ein Thema, welches eine schnelle Reaktion des CESE infolge einer begründeten Entscheidung des Primas erforderlich macht.
      N.B. Unter Abwesenheit ist die Nichtteilnahme an den Debatten der Episkopalversammlung des Heiligen Römischen Reiches oder die geistliche Einkehr zu verstehen.

    Article 13. Die Arbeit der Episkopalversammlung des Heiligen Römischen Reiches findet hinter verschlossenen Türen statt und unterliegt der Geheimhaltung; es ist absolut verboten, den Inhalt dieser Arbeit irgendjemandem außerhalb der Episkopalversammlung des Heiligen Römischen Reiches mitzuteilen, außer zum Zweck der Berichterstattung an die Höheren Institutionen des Heiligen Stuhls.


    Teil II. Die Diözesen


    I. (Erz-)Bischöfe

    Article 13. Die Episkopalversammlung des Heiligen Römischen Reiches ernennt und entlässt die (Erz-)Bischöfe des Heiligen Römischen Reiches.
    Article 14. Die folgenden Gründe sind ein Grund für eine Entlassung:
    • Abwesenheit von mehr als einem Monat ohne Rechtfertigung oder vorherige Ankündigung
    • Einmischung in die Angelegenheiten einer anderen Diözese trotz der Verwarnungen seiner Vorgesetzten
    • Undiszipliniertheit und Eigensinnigkeit (die Episkopalversammlung des Heiligen Römischen Reiches mag dies beurteilen),
    • Versagen in seinem Amt auf Anraten des Primas nach dessen Untersuchung, die der Episkopalversammlung des Heiligen Römischen Reiches vorgelegt werden soll.
    • Verlassen der Diözese ohne Mitteilung an den Primas.

      Article 14.1. Der Entzug erfolgt stillschweigend, wenn ein neuer (Erz-)Bischof an der Spitze derselben (Erz-)Diözese ernannt wird.

    Article 15. Das Verfahren zur Wahl eines neuen (Erz-)Bischofs wird in der Regel eingeleitet, wenn ein (Erz-)Bischofssitz vakant wird.

    Article 16. Die (erz-)bischöflichen Sitze werden durch den Tod, den Rücktritt oder die Abberufung des zuständigen (Erz-)Bischofs vakant.

    Article 17. Der Primas gibt die Vakanz eines (erz-)bischöflichen Sitzes auf dem Platz des Aristoteles und auf dem öffentlichen Platz des (erz-)diözesanen Territoriums bekannt und startet einen fünftägigen Aufruf zur Kandidatur.
    Article 18. Die Kandidaten sollten sich beim Primas mit einem Lebenslauf, einem theologischen Abschluss und einem Motivationsschreiben melden. Der Primas kann abwegige oder ungeeignete Kandidaten ablehnen, muss aber die Episkopalversammlung des Heiligen Römischen Reiches informieren.

    Article 19. Der Primas sammelt die Nominierungen und leitet die Wahl so schnell wie möglich ein, um sicherzustellen, dass die Wahl unter den bestmöglichen Bedingungen stattfindet.

    II. Diözesanadministratoren

    Article 20. Die Episkopalversammlung des Heiligen Römischen Reiches ernennt die Diözesanadministratoren des Heiligen Römischen Reiches für einen Zeitraum von vier Monaten.

    Article 21. Die folgenden Gründe sind ein Grund für eine Entlassung:
    • Abwesenheit von mehr als einem Monat ohne Rechtfertigung oder vorherige Ankündigung
    • Einmischung in die kirchlichen Angelegenheiten trotz der Verwarnungen seiner Vorgesetzten
    • Undiszipliniertheit und Eigensinn (die Episkopalversammlung des Heiligen Römischen Reiches möge darüber urteilen),
    • Versagen im Amt auf Empfehlung des Primas nach dessen Untersuchung, die der Episkopalversammlung des Heiligen Römischen Reiches vorgelegt werden muss.


    Article 22. Das Verfahren zur Wahl eines Diözesanadministrators wird eingeleitet, wenn ein (Erz-)Bistum des Heiligen Römischen Reiches ohne (Erz-)Bischof ist oder wenn dieser die Verwaltung in Gratibus nicht gewährleisten kann.

    Article 23. Der Primas veröffentlicht eine fünftägige Ausschreibung mit der Angabe, ob es sich um einen sede plena oder sede vacante handelt, d. h. ob es einen (Erz-)Bischof Res Parendo gibt oder nicht.

    Article 24. Die Kandidaten sollten sich beim Primas mit einem Lebenslauf, eventuellen Diplomen, ihrem Status als Pastor des Glaubens und einem Motivationsschreiben melden. Der Primas kann abwegige oder ungeeignete Kandidaten ablehnen, muss dies aber der Episkopalversammlung des Heiligen Römischen Reiches melden.

    Article 25. Der Primas sammelt die Nominierungen und leitet die Wahl so schnell wie möglich ein, um sicherzustellen, dass die Wahl unter optimalen Bedingungen stattfindet...


    Teil III. Der Primas des Heiligen Römischen Reiches


    Article 26. Der Primas repräsentiert das Primat des Heiligen Römischen Reiches und führt den Vorsitz in der Episkopalversammlung des Heiligen Römischen Reiches. Er ist verantwortlich für die Einhaltung der von der Episkopalversammlung des Heiligen Römischen Reiches aufgestellten Statuten und Richtlinien.

    Article 27. Der Primas wird aus den Reihen der Vollmitglieder der Bischofsversammlung des Heiligen Römischen Reiches für eine verlängerbare Amtszeit von 6 Monaten gewählt.

    Article 28 Alle Bewerber für das Primat müssen einen vollständigen Lebenslauf und ein Programm vorlegen.

    Article 29. Der Primas ernennt für jedes Vizeprimat einen Vizeprimas, der ihn bei der Ausübung seines Amtes unterstützt. Er kann sie nach eigenem Ermessen auswählen und entlassen, sofern sie in dem ihnen zugewiesenen Vizeprimat wohnen.

    Article 30. Bei der Ernennung von Vizeprimaten legt der Primas die Rangfolge unter ihnen fest, die ausschließlich dem Übergang der Primatsbefugnisse dient.

    Article 31. Im Falle einer unangekündigten Abwesenheit von mehr als vierzehn Tagen wird der Primas durch einen Vizeprimas gemäß der bei der Ernennung festgelegten Rangfolge ersetzt. Der Vizeprimas erhält dann alle Befugnisse, die dem Primas bis zu dessen Rückkehr zustehen.

    Article 32. Der Primas und seine Vizeprimaten achten darauf, ihre Abwesenheit anzukündigen, um einen reibungslosen Ablauf der Episkopalversammlung des Heiligen Römischen Reiches zu ermöglichen.

    Article 33. Der Primas hat ein stillschweigendes und dauerhaftes Mandat, das ihm alle Befugnisse der Episkopalversammlung des Heiligen Römischen Reiches verleiht. Er kann daher einseitig Dekrete erlassen. Diese Dekrete können wiederum von der Episkopalversammlung des Heiligen Römischen Reiches annulliert werden, wobei das Annullierungsverfahren eine aufschiebende Wirkung hat.
    Article 34 Der Primas kann von der Episkopalversammlung des Heiligen Römischen Reiches durch einen ausreichend begründeten Misstrauensantrag seines Amtes enthoben werden.

    Article 35. Im Falle des Todes, der Abberufung oder einer mehr als einmonatigen Abwesenheit des Primas ist ein Vizeprimas gemäß der bei der Ernennung festgelegten Rangfolge für den Übergang zu einer neuen Primatswahl zuständig.

Gemäß Buch 2 Teil I des Codex Iuris Canonici der Heiligen Aristotelischen, Universalen und Römischen Kirche, genannt "Regimini secularis ecclesiae", wird das Primat des Heiligen Römischen Reiches errichtet, das alle Erzdiözesen, Diözesen und Pfarreien, die sich ganz oder teilweise in den Ländern der SRING, der Provence und der Schweiz befinden, umfasst und über sie die Autorität ausübt.
 
Das Primat des Heiligen Römischen Reiches wird von der Episkopalversammlung des Heiligen Römischen Reiches in Übereinstimmung mit und innerhalb der Grenzen des Dogmas, des Kirchenrechts und der höheren Autorität der Römischen Kurie und der anderen Institutionen der Heiligen Kirche geleitet.
Das Primat des Heiligen Römischen Reiches ist aus rein organisatorischen Gründen in fünf Vizeprimate unterteilt, die jeweils die italienischen, deutschen, französischen, niederländischen und slowenischen Sprachgebiete innerhalb des Territoriums des Primats abdecken und jeweils über eine ständige Synode für die Sitzungen und Beratungen des örtlichen Episkopats verfügen.
 
Als territoriale Untergliederung der Heiligen Kirche untersteht das Primat des Heiligen Römischen Reiches natürlich der lehrmäßigen und pastoralen Autorität des Heiligen Stuhls und seiner Institutionen.

    Conformément au Livre 2 Partie I du Codex Iuris Canonici de la Sainte Église Aristotélicienne, Universelle et Romaine, nommé « Regimini secularis ecclesiae », est établie la Primatie du Saint Empire, reprenant et ayant autorité sur tous les archidiocèses, diocèses et paroisses présents en tout ou en partie sur les terres du SRING, de Provence et de Suisse.

    La Primatie du Saint Empire est dirigée par l'Assemblée Épiscopale du Saint Empire en accord avec et dans les limites du Dogme, du Droit Canon et des décisions supérieures prises par la Curie Romaine et les autres Institutions de la Sainte Église.
    La Primatie du Saint Empire est divisée, à des fins purement organisationnelles, en cinq Vice-Primaties, couvrant chacune les régions linguistiques Italique, Allemande, Française, Néerlandaise et Slovène au sein du territoire de la Primatie, et disposant chacune d'un synode permanent pour les réunions et les discussions de l'épiscopat local.

    En tant que subdivision territoriale de la Sainte Église, la Primatie du du Saint Empire est naturellement soumise à l'autorité doctrinale et pastorale du Saint-Siège et de ses institutions.



    Partie I. L'Assemblée Épiscopale du Saint Empire


    I. Composition

    Article 1. L'Assemblée Épiscopale du Saint Empire est composée de membres de droit, de membres consultants et de membres cooptés.

    Article 2 Les membres de droit ayant la parole et le droit de vote sont :
    • les (arch)evêques du Saint Empire, c'est à dire ceux élus selon les procédures canoniques Res Parendo pour gouverner un diocèse ;
    • les (arch)évêques In Partibus ayant leur résidence principale (In Gratebus) sur le territoire de la Primatie du Saint Empire ;
    • les (arch)évêques émérites ayant leur résidence principale (In Gratebus) sur le territoire de la Primatie du Saint Empire ;
    • L'ensemble des cardinaux ayant leur résidence principale (In Gratebus) sur le territoire de la Primatie du Saint Empire ;
    • les recteurs d'ordres religieux romains ayant leur résidence principale (In Gratebus) sur le territoire de la Primatie du Saint Empire ;
    • les grands maîtres d'ordres militaires religieux ayant leur résidence principale (In Gratebus) sur le territoire de la Primatie du Saint Empire .


    Article 3 Les membres consultants ayant la parole mais pas le droit de vote sont :

    • L'ensemble des Cardinaux ayant leur résidence principale (In Gratebus) hors du territoire de la Primatie du Saint Empire;
    • un délégué de la Nonciature Apostolique, nommé par ce dernier à cette fin, pourvu qu'il soit au moins ordonné ou avec rang d'évêque ;
    • un délégué des Saintes Armées, nommé par ces dernières à cette fin, pourvu qu'il soit au moins ordonné ou avec rang d'évêque.


    Article 4. Les membres cooptés, n'ayant que parole, sont nommés par l'Assemblée Épiscopale du du Saint Empire sur base de leurs qualités morales, intellectuelles et religieuses et sur proposition d'un membre de droit.


    II. Fonctionnement

    Article 5. Les décisions sont prises lors de consultations des membres de droit par vote à la majorité simple des votants.

    Article 6. Tous les membres peuvent participer aux débats, mais seuls les membres de droit peuvent lancer une consultation et voter.

    Article 7. En cas de partage égal de voix, celle du Primat du Saint Empire est prépondérante.

    Article 8. Le vote devra toujours comporter une possibilité de voter blanc ainsi qu’une possibilité de voter contre. Les votes blancs ne comptent donc pas.

    Article 9. Le vote a une durée ordinaire de cinq jours et doit toujours être précédé d'une période de débat d'un minimum de trois jours.

    Article 10. Le vote peut être lancé immédiatement et le délai de vote raccourci à trois jours en accord avec le Primat, sur sa décision ou dans les cas prévus dans les procédures d’urgence.

    Article 11. Les cas suivants autorisent la procédure d’urgence :
    • absence non déclarée du Primat et de ses Vices-Primats pendant deux semaines ;
    • conflit armé impliquant des paroisses du Saint Empire ;
    • tout débat sur un sujet qui appelle une réaction rapide de l'AESE sur décision motivée du Primat.
      N.B. par absence est entendue la non-participation aux débats de l’Assemblée Épiscopale du Saint Empire ou la retraite spirituelle

    Article 12. Les travaux de l’Assemblée Épiscopale du Saint Empire se déroulent à huis-clos et sont soumis au secret ; il est absolument interdit de divulguer le contenu dedits travaux à toute personne extérieure à l'Assemblée Épiscopale du Saint Empire sauf dans le but de faire rapport aux Institutions Supérieures du Saint-Siège.


    Partie II. Les Évêchés


    I. (Arch)Evêques

    Article 13. L'Assemblée piscopale du Saint Empire nomme et révoque les (arch)evêques du Saint Empire.

    Article 14. Les faits suivants sont des motifs de révocation :
    • absence de plus d'un mois sans justification ou annonce préalable
    • Ingérence dans les affaires d'un autre diocèse malgré les avertissements de ses supérieurs
    • indiscipline et obstination dans celle-ci, (l'Assemblée épiscopale du Saint Empire pouvant être juge de ce point),
    • échec dans sa charge sur avis du primat après enquête de celui-ci, qui doit être présentée à l'Assemblée Épiscopale du Saint Empire.
    • Abandon de son diocèse sans avoir avertis le Primat.

      Article 14.1. La révocation a lieu tacitement si un nouvel (arch)évêque est nommé à la tête du même (arch)diocèse.

    Article 15. La procédure pour l'élection d'un nouvel (arch)evêque est ordinairement lancée lorsqu'un siège (archi)épiscopal devient vacant.

    Article 16. Les sièges (archi)épiscopaux deviennent vacants au décès, à la demission ou à la révocation de l'(arch)evêque compétent.

    Article 17. Le Primat annonce la vacance d'un siège (archi)épiscopal en place d'Aristote et sur la place publique du territoire (archi)diocésain et lance un appel à candidature de cinq jours.

    Article 18. Les candidats doivent se faire connaître auprès du Primat avec un curriculum vitæ, un diplôme de licence ès théologie ainsi qu’une lettre de motivation. Le Primat peut écarter des candidatures farfelues ou inadaptées, mais il doit le signaler à l’Assemblée Épiscopale du Saint Empire.

    Article 19. Le Primat collecte les candidatures et lance le vote aussi vite que possible pour que l’élection se déroule dans de bonnes conditions.


    II. Administrateurs diocésains

    Article 20. L'Assemblée Épiscopale du Saint Empire nomme pour une durée de 4 mois les administrateurs diocésains du Saint Empire.

    Article 21. Les faits suivants sont des motifs de révocation :
    • absence de plus d'un mois sans justification ou annonce préalable
    • Ingérence dans dans le domaine spirituel malgré les avertissements de ses supérieurs
    • indiscipline et obstination dans celle-ci, (l'Assemblée épiscopale du Saint Empire pouvant être juge de ce point),
    • échec dans sa charge sur avis du primat après enquête de celui-ci, qui doit être présentée à l'Assemblée épiscopale du Saint Empire.


    Article 22. La procédure pour l'élection d'un administrateur diocésain est lancée lorsqu'un (arch)evêché du Saint Empire est sans (arch)evêque ou si celui-ci ne peut garantir l'administration In Gratibus.

    Article 23. Le Primat lance un appel à candidature de cinq jours, en précisant si le poste est sede plena ou sede vacante, c'est-à-dire respectivement s'il y a un (arch)evêque Res Parendo ou non.

    Article 24. Les candidats doivent se faire connaître auprès du Primat avec un curriculum vitæ, tout diplôme obtenu, leur statut de pasteur de la foi ainsi qu’une lettre de motivation. Le Primat peut écarter des candidatures farfelues ou inadaptées, mais il doit le signaler à l’Assemblée Épiscopale du Saint Empire.

    Article 25. Le Primat collecte les candidatures et lance le vote aussi vite que possible pour que l’élection se déroule dans de bonnes conditions.


    Partie III. Le Primat du Saint Empire


    Article 26. Le Primat représente la Primatie du Saint Empire et préside l'Assemblée Épiscopale du Saint Empire. Il doit garantir le respect des Statuts et des directives établies par l'Assemblée Épiscopale du Saint Empire.

    Article 27. Le Primat est élu parmi les membres de droit de l’Assemblée Épiscopale du Saint Empire pour un mandat renouvelable de 6 mois.

    Article 28 Tout candidat à la primatie devra fournir un curriculum vitæ complet et un programme.

    Article 29. Le Primat nomme un vice-primat pour chaque vice-primatie pour l'assister dans ses devoirs. Il peut les choisir et les révoquer comme bon lui semble sous réserve qu'ils résident dans la vice-primatie qui leur est assignée.

    Article 30.Au moment de nommer les vice-primats, le Primat établit l'ordre de priorité entre eux aux seules fins de la transition des pouvoirs primataux.

    Article 31. En cas d’absence non annoncée de plus de quatorze jours, le Primat est suppléé par un vice-primat selon l’ordre de priorité établi au moment de la nomination. Le vice-primat obtient alors tous les pouvoirs dévolus au Primat jusqu’au retour de celui-ci.

    Article 32. Le Primat et ses vices-primats veilleront à annoncer leurs absences afin de permettre le bon fonctionnement de l’Assemblée Épiscopale du Saint Empire.

    Article 33. Le Primat dispose d’un mandat tacite et permanent lui conférant tous les pouvoirs dont dispose l’Assemblée Épiscopale du Saint Empire. Il peut donc prendre des décrets de manière unilatérale. Ces décrets peuvent à leur tour être annulés par l’Assemblée Épiscopale du Saint Empire, la procédure d’annulation ayant un effet suspensif.

    Article 34 Le Primat peut être destitué par l’Assemblée Épiscopale du Saint Empire par une motion de censure suffisamment motivée.

    Article 35. En cas de décès, de destitution ou d'une absence de plus d'un mois du Primat, un vice-primat, selon l’ordre de priorité établi au moment de la nomination, est responsable de la transition vers une nouvelle élection primatiale.

    La Primazia del Sacro Romano Impero è divisa, a fini puramente organizzativi, in cinque Vice-Primazie, ciascuna delle quali copre le regioni linguistiche italiana, tedesca, francese, olandese e slovena all'interno del territorio della Primazia, e ciascuna delle quali ha un Sinodo permanente per le riunioni e le discussioni dell'episcopato locale.

    In quanto suddivisione territoriale della Santa Chiesa, la Primazia del Sacro Romano Impero è naturalmente soggetta all'autorità dottrinale e pastorale della Santa Sede e delle sue istituzioni.

    Parte I. L'Assemblea episcopale del Sacro Romano Impero


    I. Composizione

    Articolo 1. L'Assemblea Episcopale del Sacro Romano Impero è composta da membri effettivi, membri consultivi e membri cooptati.

    Articolo 2. I membri effettivi con diritto di parola e di voto sono

    • Gli (arci)vescovi del Sacro Romano Impero, cioè quelli eletti secondo le procedure canoniche Res Parendo per governare una diocesi;
    • Gli (arci)vescovi In Partibus che hanno la loro residenza principale (In Gratebus) nel territorio del Sacro Romano Impero;
    • Gli (arci)vescovi emeriti che hanno la loro residenza principale (In Gratebus) nel territorio della Primazia del Sacro Romano Impero;
    • Tutti i Cardinali che hanno la loro residenza principale (In Gratebus) nel territorio del Sacro Romano Impero;
    • I rettori degli ordini religiosi romani che hanno la loro residenza principale (In Gratebus) nel territorio della Primazia del Sacro Romano Impero;
    • i Gran Maestri degli ordini religiosi militari con residenza principale (In Gratebus) nel territorio del Sacro Romano Impero.


    Articolo 3. I membri consultivi con diritto di parola ma non di voto sono:

    • Tutti i Cardinali che hanno la loro residenza principale (In Gratebus) fuori dal territorio del Sacro Romano Impero;
    • Un delegato della Nunziatura Apostolica, da questa nominato a tale scopo, purché sia almeno ordinato o abbia il rango pari a vescovo;
    • un delegato delle Sante Armate, nominato da quest'ultima a tale scopo, purché sia almeno ordinato o abbia il rango pari a vescovo.


    Articolo 4. I membri cooptati, con il solo diritto di parola, sono nominati dall'Assemblea Episcopale del Sacro Romano Impero in base alle loro qualità morali, intellettuali e religiose e su proposta di un membro effettivo.

    II. Funzionamento

    Articolo 5. Le decisioni vengono prese in consultazione con i membri effettivi a maggioranza semplice dei votanti.

    Articolo 6. Tutti i membri possono partecipare ai dibattiti, ma solo i membri effettivi possono avviare una consultazione e una votazione.

    Articolo 7. In caso di parità di voti, è determinante il voto del Primate del Sacro Romano Impero.

    Articolo 8. Il voto deve sempre prevedere la possibilità di votare in bianco e la possibilità di votare contro. Le schede bianche, pertanto, non contano.

    Articolo 9. La votazione ha una durata ordinaria di cinque giorni e deve sempre essere preceduta da un periodo di dibattito di almeno tre giorni.

    Articolo 10. La votazione può essere avviata immediatamente e il periodo di votazione può essere ridotto a tre giorni in accordo con il Primate, su sua decisione o nei casi previsti dalle procedure di emergenza.

    Articolo 11. La procedura d'emergenza è prevista nei seguenti casi
    • assenza non dichiarata del Primate e dei suoi Vice Primati per quindici giorni;
    • conflitto armato che coinvolge le parrocchie del Sacro Romano Impero;
    • qualsiasi dibattito su un argomento che richieda una rapida reazione del CESE su decisione motivata del Primate.
      N.B. Per assenza si intende la non partecipazione ai dibattiti dell'Assemblea Episcopale del Sacro Romano Impero o il ritiro spirituale.

    Article 12. I lavori dell'Assemblea Episcopale del Sacro Romano Impero si svolgono a porte chiuse e sono soggetti a segretezza; è assolutamente vietato divulgare il contenuto di questi lavori a chiunque sia estraneo all'Assemblea Episcopale del Sacro Romano Impero, se non allo scopo di riferire alle Istituzioni Superiori della Santa Sede.


    Parte II. I vescovati


    I. (Arci)Vescovi

    Articolo 13. L'Assemblea episcopale del Sacro Romano Impero nomina e revoca gli (arci)vescovi del Sacro Romano Impero.

    Articolo 14. Sono motivi di destituzione

    • assenza per più di un mese senza giustificazione o annuncio preventivo
    • l'ingerenza negli affari di un'altra diocesi nonostante gli avvertimenti dei superiori
    • indisciplina e ostinazione nella stessa, (l'Assemblea Episcopale del Sacro Romano Impero può essere giudice di questo punto),
    • fallimento nell'incarico secondo il parere del Primate dopo un'indagine da parte di quest'ultimo, che deve essere presentata all'Assemblea episcopale del Sacro Romano Impero.
    • Abbandono della propria diocesi senza preavviso al Primate.

      Articolo 14.1. La revoca avviene tacitamente se un nuovo (arci)vescovo viene nominato a capo della stessa (arci)diocesi.



    Articolo 15. La procedura per l'elezione di un nuovo (arci)vescovo viene solitamente avviata quando una sede (arci)episcopale diventa vacante.

    Articolo 16. Le sedi (arci)episcopali diventano vacanti alla morte, alle dimissioni o alla destituzione dell'(arci)vescovo competente.

    Articolo 17. Il Primate annuncia la vacanza di una sede (arci)episcopale in Piazza Aristotele e nella piazza pubblica del territorio (arci)diocesano e lancia un appello di cinque giorni per la ricerca di candidati.

    Articolo 18. I candidati devono presentarsi al Primate con un curriculum vitae, una laurea in teologia e una lettera di motivazione. Il Primate può respingere i candidati fuori luogo o non idonei, ma deve informare l'Assemblea episcopale del Sacro Romano Impero.

    Articolo 19. Il Primate raccoglie le candidature e indice la votazione nel più breve tempo possibile per garantire che l'elezione avvenga nelle migliori condizioni possibili.

    II. Amministratori diocesani

    Articolo 20. L'Assemblea episcopale del Sacro Romano Impero nomina gli amministratori diocesani del Sacro Romano Impero per un periodo di quattro mesi.

    Articolo 21. Sono motivi di destituzione

  • assenza per più di un mese senza giustificazione o preavviso
  • l'ingerenza negli affari spirituali nonostante gli avvertimenti dei superiori
  • indisciplina e ostinazione (l'Assemblea Episcopale del Sacro Romano Impero può giudicare su questo punto),
  • fallimento nell'incarico secondo il parere del Primate dopo un'indagine da parte di quest'ultimo, che deve essere presentata all'Assemblea episcopale del Sacro Romano Impero.

    Articolo 22. La procedura per l'elezione di un amministratore diocesano viene avviata quando un (arci)vescovato del Sacro Romano Impero è privo di un (arci)vescovo o se egli non può garantire l'amministrazione In Gratibus.

    Articolo 23. Il Primate emette un bando di cinque giorni per la presentazione delle candidature, specificando se la carica è sede plena o sede vacante, cioè se c'è o meno un (arci)vescovo Res Parendo.

    Articolo 24. I candidati devono presentarsi al Primate con un curriculum vitae, eventuali diplomi conseguiti, il loro stato di pastore della fede e una lettera di motivazione. Il Primate può respingere i candidati fuori luogo o inadatti, ma deve riferirne all'Assemblea Episcopale del Sacro Romano Impero.

    Articolo 25. Il Primate raccoglie le candidature e indice la votazione nel più breve tempo possibile per garantire che l'elezione avvenga in buone condizioni.


    Parte III. Il Primate del Sacro Romano Impero


    Articolo 26. Il Primate rappresenta la Primazia del Sacro Romano Impero e presiede l'Assemblea Episcopale del Sacro Romano Impero. È responsabile dell'osservanza degli Statuti e delle linee guida stabilite dall'Assemblea Episcopale del Sacro Romano Impero.

    Articolo 27. Il Primate è eletto tra i membri effettivi dell'Assemblea Episcopale del Sacro Romano Impero per un mandato rinnovabile di 6 mesi.

    Articolo 28. Tutti i candidati a Primate dovranno fornire un curriculum vitae completo e un programma.

    Articolo 29. Il Primate nomina per ogni Vice-Primazia un Vice Primate che lo assiste nelle sue funzioni. Egli può scegliere e revocare i Vice Primati come ritiene opportuno, purché risiedano nella Vice Primazia loro assegnata.

    Articolo 30. Nel nominare i Vice Primati, il Primate stabilisce l'ordine di priorità tra di loro al solo scopo di passare i poteri del Primate.

    Articolo 31. In caso di assenza non annunciata di oltre quattordici giorni, il Primate è sostituito da un Vice Primate secondo l'ordine di priorità stabilito al momento della nomina. Il vice-primate ottiene quindi tutti i poteri spettanti al Primate fino al suo ritorno.

    Articolo 32. Il Primate e i suoi Vice Primati avranno cura di annunciare le loro assenze per consentire il regolare svolgimento dell'Assemblea Episcopale del Sacro Romano Impero.

    Articolo 33. Il Primate ha un mandato tacito e permanente che gli conferisce tutti i poteri dell'Assemblea Episcopale del Sacro Romano Impero. Può quindi emanare decreti unilateralmente. Questi decreti possono a loro volta essere annullati dall'Assemblea episcopale del Sacro Romano Impero; la procedura di annullamento ha effetto sospensivo.

    Articolo 34. Il Primate può essere rimosso dall'incarico dall'Assemblea episcopale del Sacro Romano Impero con una mozione di censura sufficientemente motivata.

    Articolo 35. In caso di morte, rimozione o assenza per più di un mese del Primate, un Vice Primate, secondo l'ordine di priorità stabilito al momento della nomina, è responsabile della transizione verso una nuova elezione primaziale.

In conformità al Libro 2 Parte I del Codex Iuris Canonici della Santa Chiesa Aristotelica, Universale e Romana, chiamato "Regimini secularis ecclesiae", è istituita la Primazia del Sacro Romano Impero, che ha il controllo e ha autorità su tutte le arcidiocesi, le diocesi e le parrocchie presenti in tutto o in parte nelle terre del SRING, della Provenza e della Svizzera.

La Primazia del Sacro Romano Impero è diretta dall'Assemblea Episcopale del Sacro Romano Impero in conformità e nei limiti del Dogma, del Diritto Canonico e della superiore autorità della Curia Romana e delle altre Istituzioni della Santa Chiesa.
