Vu le dogme ;
Vu la deuxième partie de la bulle Ad mundi salutem per sanctificationem relative au sacrement du mariage ;
Vu l’article 6.5 de la première partie de la bulle De Sanctae Sedis summo administratione relatif au pouvoir législatif des consistoires ;
Vu l’indult consistorial du vingt-cinq juillet quatorze cent soixante-deux instaurant une procédure simplifiée ;
Considérant la longueur des procédures d’extinction et de dissolution des mariages ;
Considérant que certaines officialités peuvent temporairement rencontrer quelques difficultés à se réunir au complet ;
Considérant que certaines circonstances ne nécessitent pas d’instruction par un procureur ecclésiastique ni de délibération par un jury ;
Considérant, enfin, que le consistoire reste souverain pour vérifier et valider les propositions des officialités et éviter tout abus ou décision arbitraire ;
Le consistoire pontifical francophone met en place une procédure simplifiée pour les extinctions et dissolutions de mariage régie par les dispositions suivantes.
Article 1 – Du principe d’une procédure simplifiée.
I. Après réception de la requête, si les conditions sont réunies, le président de l’officialité épiscopale concernée peut lancer une procédure simplifiée consistant en un entretien avec le ou les requérants, suivi de la rédaction d’un procès-verbal, contresigné par le ou les requérants complété par les recommandations de pénitence et de sa transmission au Consistoire qui établira un arrêt après examen.
II. Dans le cas des extinctions, l’arrêt est rédigé directement par le président de l’officialité.
Article 2 – Extinction simplifiée de mariage (Ad mundi salutem per sanctificationem, II-B-3).
En cas de décès avéré d’un des époux, le président de l’officialité du lieu de résidence du membre survivant constate les faits et rédige un arrêt d’extinction. Ce dernier peut notamment être rédigé à l’occasion de la cérémonie de funérailles, la demande de cérémonie ayant alors la valeur d’une requête d’extinction.

Article 3 – Dissolution simplifiée de mariage.
I. Excommunication.
Dès lors que l’un des époux fait l’objet d’une excommunication, qu’elle soit constatée par un cardinal, un Consistoire ou la Curie (latæ sententiæ) ou prononcée par une juridiction ecclésiastique (ferendæ sententiæ), l’autre époux peut déposer auprès du président de l’officialité une requête de dissolution, en particulier si le couple a des enfants. Dans le cas où une procédure de réintégration est en cours, la requête de dissolution est suspendue.Le Consistoire est libre de prendre toute décision ou définir toute pénitence qu'il jugera nécessaire.
II. Abandon du domicile (Ad mundi salutem per sanctificationem, II-B-6.4).
A. Dans le cas où il est de « notoriété publique » que l’un des conjoints a quitté le domicile depuis trois mois ou plus, la requête de dissolution de mariage introduite par le conjoint délaissé peut aboutir à une procédure simplifiée.

B. Une interdiction forfaitaire de remariage de 2 mois est infligée à l’époux requérant, pour l’aider à méditer sur son mauvais choix de conjoint. Une interdiction forfaitaire de remariage de 3 mois est infligée à l’époux disparu, à partir de la date où il se sera confessé auprès d’un clerc au sujet de son abandon de domicile. Par défaut, les enfants sont confiés à la garde exclusive du conjoint demandeur.
III Disparition des sentiments amoureux (Ad mundi salutem per sanctificationem, II-B-6.1).
A. Une procédure simplifiée de dissolution pour disparition des sentiments amoureux peut être lancée si les conditions cumulatives suivantes sont respectées :
1. la disparition des sentiments concerne les deux époux ;
2. qu’aucun grief n’est soulevé ;
3. les époux ont fait les efforts nécessaires pour empêcher cette situation ;
4. il y a un accord sur la garde des enfants.
B. Le président de l'officialité inflige une interdiction de remariage d'un minimum de 4 mois à chacun des époux pour leur donner le temps de méditer sur les causes de l’échec de leur mariage. Outre au minimum une confession donnée à chaque époux, ceux-ci peuvent se voir infliger d'autres types de pénitences.
IV. Obligation d'entretien.
En cas de dissolution de mariage, chacun des époux devra être reçu en entretien avant tout remariage par le clerc de la paroisse où le sacrement doit être délivré ou à l'évêque. Le contenu de l'entretien est protégé par le secret de la confession.

L'acte d'extinction est retiré automatiquement si la cérémonie d'ordination ou d'intronisation conventuelle ou monastique n'a pas eu lieu dans les 21 jours.

1. The feast Corpus Christosi has been renamed Feast of friendship. It is still the same feast as before and the only thing to have changed is the name. It has been celebrated previously on the 20th of April, which was the wrong date. Since 1461, the feast is held every year on the 8th of June.
2. The feast Ascension (death of Christos) has been renamed Commemoration of the Elevation Of Christos (Death of Christos). It is still the same feast as before and the only thing to have changed is the name. It has been celebrated previously on the 2nd of Mai, which was the wrong date. Since 1461, the feast is held every year on the 13th of June.
3. The exact date of Aristotle's death is unknown, but we know that the Prophet died during a hot season corresponding to the summer. The feast can therefore be held on different days depending of the year, while still remaining in the period between the summer solstice and the autumn equinox.
4. Certain feasts or celebrations are associated to specific Sundays, in a specific time on the year. According to the calendar day on which the Sunday falls, the dates will vary from year to year. As such, the celebration day of Ash Wednesday, the Feast of Renewal, the Day of the Archangels and the feast of God's Children change every year.
5. All other celebrations and feasts stay on the same exact date, every year. |

3. The exact date of Aristotle's death is unknown, but we know that the Prophet died during a hot season corresponding to the summer. The feast can therefore be held on different days depending of the year, while still remaining in the period between the summer solstice and the autumn equinox.
4. Certain feasts or celebrations are associated to specific Sundays, in a specific time on the year. According to the calendar day on which the Sunday falls, the dates will vary from year to year. As such, the celebration day of Ash Wednesday, the Feast of Renewal, the Day of the Archangels and the feast of God's Children change every year.

We, the Cardinals of the Holy Aristotelian Church gathered in the Sacred College, in the name of Pope Innocent VIII and under the gaze of Aristotle,
Have ruled and ordered, and by our present perpetual and definitive edict, declare, rule and order, the appointment of His Eminence Maddel Solus [ Maddel ] to the rank of emeritus national cardinal, following his resignation.
We thank His Eminence for his work in the service of the Church.
