Regarding your questions. I will indeed correct you, with all due respect. Yes, the King or the Emperor (for imperial fief) determines who is noble. However, the church would like that only Aristotelians can be ennobled. The church would like that, if an Aristotelian noble is excommunicated, he loses his nobility immediately. This was the case, until the empire changed those laws years ago. The church is still fighting to get this “right” again. Effectively, this is a right to determine who is noble and who is not. Effectively, this is a right to put pressure on people by telling them: "if you do not defend our interest, you will lose everything immediately". And this is exactly what happened in the past and what is still happening. Several excommunicated imperial nobles did everything to lift their excommunication.
The same can be applied to the Regents of provinces. A person couldn’t be regent of a province if not Aristotelian. And had to step down if the church, suddenly, decided to excommunicate him. Actually, this is a question that was raised during last Royal elections as well. Should the king be baptized? Some people argue that only baptized people can become King of the German Kingdom. I assure you that this, per law, is wrong. The issue with baptisms was, at some point, so important that a person in some imperial provinces couldn't even be a teacher in university if not baptized. Because the church forced this into their concordate and they were not able to change the concordate anymore. The Empire made a law to stop this nonsense. The church is still fighting this law until today and is still considering this law as heretic. Regarding regents, I can give the example of that time, military orders of the church raised an army in the province of Modena (or Genova, I don’t remember exactly), to take the castle because the elected regent was excommunicated. This almost led to a civil war.
The church excommunicated Emperors and declared the Imperial Bulla Area a heretic text because it gives the right to non-Aristotelians to have a recognized civil marriage. Moreover, one time, we decided to do a step towards the Church, to change this text and adopt, almost word by word, a text regarding such marriages in the French Kingdom. The text of the French kingdom was accepted by the Church but when the Empire presented the same text, they still refused. Even though, again, it was almost word by word the same text. Yes, those examples I gave are real examples. Examples of things that really happened.
Other examples I can give are regarding several imperial nobles from italic provinces who were excommunicated and are being asked (until today) to give away their imperial fiefs in order to lift the excommunication only because they followed Imperial orders to defend a city in the province of Siena and refused the orders of the Pope to declare, back then, that city as free city and annex it to the papal states.
The church also decided to declare some parts of the Magna Carta as heretical because, for example, it said that no one can « be prosecuted for what they are or what they believe » . Yes, the church is trying to influence too much into the political life of the Empire and its provinces. Yes, people have the right to be elected Regent of their province or King, regardless if they are baptized or not. It’s the voters who decide if they want a baptized person or not.
Again, this last reform came because, once again, the church tried to use its political power inside the Empire in order to overturn all the reforms that were made since years to imperial laws and constitution.
Once again, you have the right to disagree. You have the right to think that the church laws are higher than the laws of the Empire. You have the right to argue that, in your opinion, only baptized persons can be regents of their province or kings. You have the right to think that it’s your Cardinal who decides if you are Aristotelian enough to stay noble and keep your fiefs or not. It’s not my opinion. It’s not the opinion of the majority in the Empire. The laws of the Empire are applied everywhere.
Perhaps tomorrow the DKR will enact a law that you do not agree with. Perhaps tomorrow, the DKR will enact a law that is accepted by 5 provinces but was rejected by one province. It happens. We must respect all opinions. But at the end of the day, the law will be applied on all. It’s the same regarding the laws of the Empire.
