    Partie V : Des peines et des pénitences


    Dans son devoir apostolique, la Sainte Eglise a pour charge la salvation des âmes des fidèles de Dieu. Comme une mère aimante, elle a à cœur d’élever ses enfants et afin de les protéger d’un plus grand mal encore, elle se doit parfois d’agir avec fermeté et discipline. Chaque peine ou sanction envers un fidèle est une œuvre de charité et d’éducation visant à lui permettre de prendre conscience de ses erreurs, de s’en amender et faire pénitence.

    Section A : De la nature des peines et des pénitences


    Généralités

    Article 1 : L'Église a le droit inné et propre de contraindre par des sanctions pénales les fidèles délinquants.

    Article 2 : Les peines sont subdivisés en peines médicinales et peines expiatoires.

    Article 3 : En outre des pénitences peuvent être utilisés pour remplacer une peine ou l'augmenter.

    Article 4 : Ordinairement la peine est ferendae sententiae, de telle sorte qu'elle n'atteint pas le coupable tant qu'elle n'a pas été infligée par l'autorité ecclésiastique compétente.

    Article 5 : En raison de sa gravité la peine peut être latae sententiae, de telle sorte qu'elle est encourue par le fait même de la commission du délit; dans ce cas l'autorité ecclésiastique n'a qu'à vérifier son exécution.


    Section B : Des peines médicinales


    Généralités

    Article 6 : Ainsi qu'un médicament à maladie corporelle, les peines médicinales ont la fin de l'amendement du fidèle délinquant et de le faire retirer de sa conduite illicite.

    Article 7 : Les peines médicinales sont les plus graves qui peuvent être imposées à un fidèle.

    Article 8 : Les peines médicinales sont l'excommunication, l'interdit et la suspense a divinis.


    L'excommunication

    Article 9 : On entend par excommunication une sanction disciplinaire extraordinaire prise par l'autorité ecclésiastique compétente à destination d’un fidèle ou d’un groupe de fidèles.

    Article 10 : La prononciation de l'excommunication a pour cause une action grave et persistante contraire au Dogme, à la Doctrine et au Droit Canon ainsi qu’une attitude hostile et rebelle contre l’autorité ecclésiastique.

    Article 11 : La prononciation de l'excommunication est la prérogative exclusive du Souverain Pontife et des Cardinaux.

    Article 12 : Les Consistoires Pontificales sont habilités à prononcer l'excommunication à l’encontre d’un fidèle de la zone géodogmatique dont ils sont responsables.

    Article 13 : Le Souverain Pontife et les Cardinaux du Sacré-Collège sont habilités à prononcer l'excommunication à l’encontre de tout fidèle aristotélicien.

    Article 14 : Le Grand Inquisiteur Major et le Grand Inquisiteur sont habilités à prononcer l'excommunication à l’encontre d’un fidèle reconnu coupable dans les tribunaux de la Sainte Inquisition.

    Article 15 : Toute autorité ecclésiastique est habilité à demander la prononciation de l'excommunication envers tout fidèle aristotélicien reconnu coupable dans ses tribunaux.

      n.b. : Chaque prononciation de l'excommunication doit être approuvé par le Sacré-Collège des Cardinaux.

    Article 16 : Chaque excommunication doit être communiquée et enregistrée au registre géré par l’Office de Index et dépendant de la Chancellerie pontificale. Elle y sera retirée après chaque levée, mais sera maintenue dans les archives.

    Article 17 : L'excommunication exclue la personne fautive de la Communion des Saints et de l'Amitié Aristotélicienne. Elle est donc privée de messe et de sacrements, ne peut pas accéder ni être enterré dans un lieu sacré et ne peut pas atteindre le Paradis Solaire.

    Article 18 : L'excommunication avec anathème est une forme plus grave d'excommunication qui implique l'exclusion de l'Église elle-même. Elle ne peut être prononcé que par le Souverain Pontife et le Sacré-Collège des Cardinaux.

    Article 19 : En outre, pour assurer l'orthodoxie et l'harmonie au sein de la communauté aristotélicienne, chaque fidèle est obligé d'éviter la personne excommunié et de lui nier toute aide, qu'il soit matériel ou moral.

    Article 20 : L'excommunication latae sententiae ne peut être prononcé que pour des actions schismatiques, l'agression contre le Souverain Pontife ou tout crime pour lequel elle est prévue.

    Article 21 : L'excommunication est levé seulement après l’absolution et la réparation des fautes commises et la réconciliation du pénitent avec Dieu et la Sainte Eglise à travers le sacrement de la confession et l’accomplissement de sa pénitence.

    Article 22 : La levée de l'excommunication entraîne le recouvrement des droits de baptisés. Le fidèle est donc à réintégré dans la communauté aristotélicienne et a accès aux messes, aux sacrements et aux droits concordataires, .


    L'interdit

    Article 23 : On entend par interdit une sanction disciplinaire extraordinaire prise par l'autorité ecclésiastique compétente à destination d’un fidèle ou d’un groupe de fidèles.

    Article 24 : La mise sous interdit a pour cause une action persistante contraire au Dogme, à la Doctrine et au Droit Canon ainsi qu’une attitude hostile et rebelle contre l’autorité ecclésiastique.

    Article 26 : La mise sous interdit est la prérogative des sièges épiscopaux à l’encontre d’un fidèle du diocèse. Leur juridiction étant territoriale et inscrite dans les limites diocésaines, la sanction ne peut être attribuée qu’à un ressortissant des paroisses du diocèse.

    Article 27 : Par délégation du Souverain Pontife, la Congrégation de la Sainte Inquisition est habilitée à mettre sous interdit tout fidèle aristotélicien reconnu coupable dans ses tribunaux. Sa juridiction étant universelle, elle ne se soumet pas aux limites territoriales diocésaines.

    Article 28 : Chaque mise sous interdit doit être communiquée et enregistrée au registre géré par l’Office de Index et dépendant de la Chancellerie pontificale. Elle y sera retirée après chaque levée, mais sera maintenue dans les archives.

    Article 29 : La mise sous interdit suspend la personne fautive de ses droits de baptisée. Elle est donc privée de messe et de sacrements pour toute la durée de sa mise sous interdit. Idem, et suivant les clauses concordataires particulières, la personne fautive est suspendue des droits temporels en dépendant.

    Article 30 : Un interdit relevant toujours d’une juridiction particulière, il ne peut être levé que par l’autorité ecclésiastique compétente ayant décidé de saisir ses droits disciplinaires.

    Article 31 : L’interdit a un caractère conservatoire. Il n’est donc pas définitif mais est effectif durant toute la durée de la suspension jusqu’à la levée de la sanction.

    Article 32 : L’interdit est définitivement levé après l’absolution des fautes commises et la réconciliation du pénitent avec Dieu et la Sainte Eglise à travers le sacrement de la confession et l’accomplissement de sa pénitence.

    Article 33 : La levée de l’interdit entraîne le recouvrement des droits de baptisés. Le fidèle est donc à réintégré dans la communauté aristotélicienne et a accès aux messes, aux sacrements et aux droits concordataires.


    La suspense a divinis

    Article 34 : On entend par suspense a divinis une sanction disciplinaire extraordinaire, équivalente à l'interdit, prise par l'autorité ecclésiastique compétente à destination d’un clerc ordonné ou non.

    Article 35 : La prononciation de la suspense a divinis est la prérogative des sièges épiscopaux à l’encontre d’un clerc du diocèse. Leur juridiction étant territoriale et inscrite dans les limites diocésaines, la sanction ne peut être attribuée qu’à un ressortissant des paroisses du diocèse.

    Article 36 : Par délégation du Souverain Pontife, il est prérogative de la Pénitencerie Apostolique, de la Rote Romaine et du Tribunal Suprême de la Signature Apostolique de prononcer la suspense a divinis à l’encontre des clercs fautifs. Un clerc sous enquête peut se faire suspendre durant les procédures.

    Article 37 : Chaque suspense a divinis doit être communiquée et enregistrée au registre géré par l’Office de Index et dépendant de la Chancellerie pontificale. Elle y sera retirée après chaque levée, mais sera maintenue dans les archives.

    Article 38 : La suspense a divinis suspend le clerc fautif de sa charge pastorale ou apostolique. Il lui est donc interdit de célébrer la messe, de distribuer les sacrements, d’occuper une charge ecclésiastique et de parler au nom de l’Eglise pour toute la durée de sa suspense.

    Article 39 : La levée de la suspense a divinis entraîne le recouvrement des droits pastoraux ou apostoliques. Le clerc est ainsi réintégré au sein du Clergé aristotélicien et peut de nouveau célébrer la messe, distribuer des sacrements, occuper une charge cléricale et parler au nom de l’Eglise.


    Section C : Des peines expiatoires


    Généralités

    Article 40 : Les peines expiatoires ont la fin de punir le fidèle délinquant pur rétablir la justice et promouvoir sa repentance.

    Article 41 : Les peines expiatoires peuvent être appliqués à perpétuité, pour un temps fixé d'avance ou un temps indéterminé.

    Article 42 : Les peines expiatoires s’expriment d'une manière proportionnelle aux conditions particulières du coupable et à la gravité de la faute.

    Article 43 : Toute autorité ecclésiastique compétente est libre de décider de la peine expiatoire à soumettre dans les limites de la proportionnalité et des normes locales et universelles.

      n.b. : Pour normes locales et universelles on entend ceux émanés , respectivement, par le Consistoire Pontificale compétent et par le Sacré Collège des Cardinaux ou par la Congrégation de la Sainte Inquisition.

    Article 44 : La seule autorité ecclésiastique compétente pour infliger des peines expiatoires est le tribunal compétent pour le délit en question.

    Article 45 : Les peines expiatoires indispensables sont les suivants :

      - L'ordre de demeurer dans un lieu ou un territoire donné;
      - Le transfert forcé à un autre office;
      - La privation d'un pouvoir, d'un office, d'une charge, d'un droit, d'un privilège, d'une faculté, d'une faveur, d'un titre;
      - L'interdiction d'exercer un pouvoir, un office, une charge, un droit, un privilège, une faculté, une faveur ou de le faire dans un lieu ou hors d'un lieu donné;
      - La réduction à l'état laïc
      - L'interdiction de mariage ou de remariage;


    Section D : Des pénitences


    Généralités

    Article 46 : La pénitence consiste dans l'accomplissement d'une oeuvre de religion, de piété ou de charité.

    Article 47 : La pénitence s’exprime d'une manière proportionnelle aux conditions particulières du coupable et à la gravité de la faute.

    Article 48 : Où il est appliqué en remplacement ou en augmentation, la pénitence est une condition indispensable pour la levée de la peine principale.

    Article 49 : Toute autorité ecclésiastique compétente est libre de décider de la pénitence à soumettre dans les limites de la proportionnalité.

    Article 50 : Des pénitences particulières peuvent être établies par des normes locales et universelles.

      n.b. : Pour normes locales et universelles on entend ceux émanés , respectivement, par le Consistoire Pontificale compétent et par le Sacré Collège des Cardinaux ou par la Congrégation de la Sainte Inquisition.


    Section E : Des sanctions hors de la communauté aristotélicienne


    Généralités

    Article 51 : Lorsque le dogme et l'orthodoxie sont sévèrement refusés avec une grave perturbation de la communauté des fidèles, la Sainte Eglise peut agir contre les infidèles avec des sanctions exceptionnelles.


    La mise au ban

    Article 52 : On entend par mise au ban une sanction exceptionnelle prise par l'autorité ecclésiastique compétente à destination d’une personne en dehors de la communauté aristotélicienne.

    Article 53 : La mise au ban a pour cause une action persistante contraire au Dogme, à la Doctrine ainsi qu’une attitude hostile et rebelle contre l’autorité ecclésiastique, qui provoque une grave perturbation de la communauté des fidèles.

    Article 54 : La mise au ban est la prérogative des sièges épiscopaux à l’encontre d’une personne en dehors de la communauté aristotélicienne qui réside dans le territoire du diocèse. Leur juridiction étant territoriale et inscrite dans les limites diocésaines, la sanction ne peut être attribuée qu’à un ressortissant des paroisses du diocèse.

    Article 55 : Par délégation du Souverain Pontife, la Congrégation de la Sainte Inquisition est habilitée à mettre au ban tout personne en dehors de la communauté aristotélicienne reconnu coupable dans ses tribunaux. Sa juridiction étant universelle, elle ne se soumet pas aux limites territoriales diocésaines.

    Article 56 : Chaque mise au ban doit être communiquée et enregistrée au registre géré par l’Office de Index et dépendant de la Chancellerie pontificale. Elle y sera retirée après chaque levée, mais sera maintenue dans les archives.

    Article 57 : La mise au ban exclut ab imis la personne fautive de la communauté aristotélicienne et de l'Église. Elle est donc privée de messe et des sacrements, surtout du baptême, pour toute la durée de sa mise au ban.

    Article 58 : En outre, pour assurer l'orthodoxie et l'harmonie au sein de la communauté aristotélicienne, chaque fidèle est obligé d'éviter la personne mise au ban et de lui nier toute aide, qu'il soit matériel ou moral.

    Article 59 : La mise au ban est levé après l’absolution des fautes commises et la réconciliation du pénitent avec Dieu et la Sainte Eglise, suite à la reconnaissance de la vérité du Dogme et l'abiuration des actions perturbatrices.

    Article 60 : La levée du ban entraîne la récupération de la possibilité de se joindre à la communauté des fidèles.

    Part V : Penalties and penances


    In his apostolic duty, the Holy Church is responsible for the salvation of the souls of the faithful of God. Like a loving mother, she cares about raising her children and to protect them from even greater harm, she sometimes has to act with firmness and discipline. Every punishment or sanction towards a faithful is a work of charity and education aimed at allowing him to become aware of his errors, to make amends and to do penance.

    Section A :The nature of sentences and penances


    Generalities

    Article 1 : The Church has the inherent and inherent right to compel by criminal sanctions the delinquent faithful.

    Article 2 :The sentences are subdivided into medicinal penalties and expiatory penalties.

    Article 3 : In addition penances can be used to replace a sentence or increase it.

    Article 4 : Ordinarily the sentence is ferendae sententiae, so that it does not reach the culprit until it has been inflicted by the competent ecclesiastical authority.

    Article 6 : As well as a medicine with bodily disease, the medicinal penalties have the end of the amendment of the faithful delinquent and to have it removed from its illicit conduct.

    Article 7 : Medicinal penalties are the most serious that can be imposed on a faithful.

    Article 8 : Medicinal sentences are excommunication, forbidden and suspense a divinis.


    Excommunication

    Article 9 : An excommunication is understood to mean an extraordinary disciplinary sanction taken by the competent ecclesiastical authority for a faithful or a group of the faithful.

    Article 10 : The pronunciation of the excommunication is due to a serious and persistent action contrary to Dogma, Doctrine and Canon Law as well as a hostile and rebellious attitude against the ecclesiastical authority.

    Article 11 : The pronunciation of excommunication is the exclusive prerogative of the Sovereign Pontiff and the Cardinals.

    Article 12 : The Pontifical Consistories are empowered to pronounce excommunication against a faithful of the geodogmatic zone for which they are responsible.

    Article 13 : The Sovereign Pontiff and the Cardinals of the Sacred College are empowered to pronounce excommunication against any Aristotelian faithful.

    Article 14 : The Grand Inquisitor Major and the Grand Inquisitor are empowered to pronounce excommunication against a believer found guilty at the courts of the Holy Inquisition.

    Article 15 : Every ecclesiastical authority is entitled to demand the pronunciation of excommunication from any Aristotelian believer found guilty at his courts.

      e.g. : Each pronunciation of the excommunication must be approved by the Sacred College of Cardinals.

    Article 16 : Each excommunication must be communicated and recorded in the register managed by the Office of Index and dependent on the Pontifical Chancellery. It will be withdrawn after each release, but will be kept in the archives.

    Article 17 : Excommunication excludes the person at fault from the Communion of Saints and Aristotelian Friendship. She is therefore deprived of Mass and Sacraments, can not access or be buried in a sacred place and can not reach the Solar Paradise.

    Article 18 : Excommunication with anathema is a more serious form of excommunication which implies the exclusion of the Church herself. It can only be pronounced by the Sovereign Pontiff and the Sacred College of Cardinals.

    Article 19 : In addition, to ensure orthodoxy and harmony within the Aristotelian community, every believer is obliged to avoid the excommunicated person and to deny any assistance, whether material or moral.

    Article 20 : Excommunication latae sententiae can only be pronounced for schismatic actions, aggression against the Sovereign Pontiff or any crime for which it is intended.

    Article 21 : Excommunication is lifted only after the absolution and reparation of the faults committed and the reconciliation of the penitent with God and the Holy Church through the sacrament of confession and the accomplishment of his penance.

    Article 22 : The lifting of excommunication entails the recovery of the rights of the baptized. The faithful is therefore reintegrated into the Aristotelian community and has access to masses, sacraments and concordat rights.


    The ban

    Article 23 : Prohibited is an extraordinary disciplinary sanction taken by the competent ecclesiastical authority for a faithful or group of the faithful.

    Article 24 : The prohibition is due to a persistent action contrary to Dogma, Doctrine and Canon Law as well as a hostile and rebellious attitude against the ecclesiastical authority.

    Article 26 : The prohibition is the prerogative of the episcopal seats against a faithful of the diocese. Their jurisdiction being territorial and inscribed within the diocesan limits, the sanction can be attributed only to a national of the parishes of the diocese.

    Article 27 : By delegation of the Sovereign Pontiff, the Congregation of the Holy Inquisition is empowered to ban any Aristotelian believer found guilty in his courts. Its jurisdiction being universal, it does not submit to the diocesan territorial limits.

    Article 28 : Each prohibition must be communicated and registered in the register managed by the Office of Index and dependent on the pontifical Chancellery. It will be withdrawn after each release, but will be kept in the archives.

    Article 29 : The prohibition suspends the person at fault of his baptized rights. He is therefore deprived of Mass and Sacraments for the duration of his banishment. Idem, and according to particular concordat clauses, the guilty person is suspended temporal rights dependent.

    Article 30 : Since a prohibition always comes under a particular jurisdiction, it can only be lifted by the competent ecclesiastical authority that has decided to seize its disciplinary rights.

    Article 31 : The prohibition has a conservatory character. It is not definitive but is effective throughout the duration of the suspension until the lifting of the sanction.

    Article 32 : The prohibition is definitively lifted after the absolution of the faults committed and the reconciliation of the penitent with God and the Holy Church through the sacrament of confession and the accomplishment of his penance.

    Article 33 : The lifting of the prohibition entails the recovery of the baptized rights. The faithful is therefore reintegrated into the Aristotelian community and has access to masses, sacraments and concordat rights.


    The suspense has divinis

    Article 34 : Suspense a divinis an extraordinary disciplinary sanction, equivalent to the prohibition, taken by the competent ecclesiastical authority to an ordained or unordered cleric.

    Article 35 : The pronunciation of suspense a divinis
    is the prerogative of episcopal seats against a cleric of the diocese. Their jurisdiction being territorial and inscribed within the diocesan limits, the sanction can be attributed only to a national of the parishes of the diocese.

    Article 36 : By delegation of the Sovereign Pontiff, it is the prerogative of the Apostolic Penitentiary, the Roman Rota and the Supreme Tribunal of the Apostolic Signature to pronounce the suspensea divinis against faulty clerics. A clerk under investigation may be suspended during the proceedings.

    Article 37 : Every suspense a divinis must be communicated and registered in the register managed by the Office of Index and dependent on the pontifical Chancellery. It will be withdrawn after each release, but will be kept in the archives.

    Article 38 : The suspense a divinis suspends the faulty cleric from his pastoral or apostolic office. It is therefore forbidden for him to celebrate mass, to distribute the sacraments, to occupy an ecclesiastical office and to speak in the name of the Church for the duration of his suspense.

    Article 39 : The lifting of suspense a divinis
    entails the recovery of pastoral or apostolic rights. The cleric is thus reinstated within the Aristotelian Clergy and can once again celebrate the Mass, distribute sacraments, occupy a clerical office and speak on behalf of the Church.


    Section C : Expiatory sentences


    Generalities

    Article 40 : Expiatory penalties have the purpose of punishing the faithful offender to restore justice and promote his repentance.

    Article 44 : The only ecclesiastical authority competent to impose expiatory sentences is the competent court for the offense in question.

    Article 45 : The necessary expiatory penalties are as follows:

      - the order to remain in a given place or territory;
      - Forced transfer to another office;
      - the deprivation of a power, an office, a charge, a right, a privilege, a faculty, a favor, a title;
      - Prohibition of the exercise of a power, office, office, right, privilege, faculty, favor or doing so in or out of a given place;
      - The reduction to the lay state
      - Prohibition of marriage or remarriage;


    Section D : Penences

    Section E : Sanctions outside the Aristotelian community


    Generalities

    Article 51 : When dogma and orthodoxy are severely denied with a serious disruption of the community of the faithful, the Holy Church can act against infidels with exceptional sanctions.


    Raising a ban

    Article 52 : Banishment means an exceptional sanction taken by the competent ecclesiastical authority for a person outside the Aristotelian community.

    Article 53 : [/bThe banishment has for cause a persistent action contrary to the Dogma, the Doctrine as well as a hostile and rebellious attitude against the ecclesiastical authority, which causes a serious disturbance of the community of the faithful.

    [b]Article 54 :
    Banishment is the prerogative of episcopal seats against a person outside the Aristotelian community residing in the territory of the diocese. Their jurisdiction being territorial and inscribed within the diocesan limits, the sanction can be attributed only to a national of the parishes of the diocese.

    Article 55 : By delegation of the Sovereign Pontiff, the Congregation of the Holy Inquisition is empowered to ban anyone outside the Aristotelian community found guilty in its courts. Its jurisdiction being universal, it does not submit to the diocesan territorial limits.

    Article 56 : Each ban must be communicated and registered in the register managed by the Office of Index and dependent on the pontifical Chancellery. It will be withdrawn after each release, but will be kept in the archives.

    Article 57 : Banning excludes ab imisthe faulty person in the Aristotelian community and the Church. He is deprived of Mass and sacraments, especially baptism, for the duration of her banishment.

    Article 58 : In addition, to ensure orthodoxy and harmony within the Aristotelian community, every believer is obliged to avoid the person being banished and to deny him any help, whether material or moral.

    Article 60 : The lifting of the ban leads to the recovery of the possibility of joining the community of the faithful.
