    Book 5.3 : The Apostolic Nunciature


      The Apostolic Nunciature is the Roman dicastery charged with the diplomatic representation of the Holy See before lay institutions, as well as with the negotiation and conclusion of Concordats, treaties, conventions and agreements of any kind subject to ratification by the Roman Curia, either by decision of the Supreme Pontiff or by a vote of the Sacred College of Cardinals. Unless expressly authorised by Canon Law or by the Holy See itself, no other institution or person, other than the Apostolic Nunciature and its diplomatic staff, may claim to represent or conclude agreements of any kind whatsoever in the name of the Holy Church, of one of its institutions or branches.



    I. Of the hierarchy of the dicastery

    Can. 1: The Apostolic Nunciature is headed by a Chancellor and a Vice-Chancellor, who bear the title of Apostolic Apocrisiary and Vicar Apostolic Apocrisiary respectively.

    Can. 2: The Chancellors, after the advice of the Superior Council, appoint a Prefect General, with the title of Apostolic Prothonotary; he is responsible for assisting the Chancellors in the management of the dicastery in accordance with their directives.

    Can. 3: The Chancellors, after the advice of the Superior Council, appoint a Local Prefect, bearing the title of Apostolic Secretary, for each geodogmatic zone; they are responsible for coordinating diplomatic activity in their zone, with due regard for the directives of the Chancellors and the Apostolic Prothonotary.

      Can. 3.1: The Chancellors, after the advice of the Superior Council and if necessary for larger geodogmatic zones, may appoint a Vice-Prefect, bearing the title of Apostolic Vice-Secretary, who shall assist the corresponding Apostolic Secretary in the exercise of their functions, with due regard for the directives of their superiors.

    Can. 4: The Chancellors, or the Apostolic Prothonotary by their delegation or in their absence, after the advice of the Superior Council, appoint a diplomatic representative for each independent or autonomous state, who will bear the title of Apostolic Nuncio if they are an ordained priest or Apostolic Ambassador if they are a lay faithful.

    n.b. : for the purposes of this canon, an autonomous state is one which, whether or not it is part of a sovereign state, has de facto or de iure autonomy to negotiate and conclude treaties.


    II. Of the Superior Council of the Nunciature and of the Apostolic Secretariats

    Can. 6: The Superior Council of the Nunciature is the highest consultative body of the dicastery; it is composed of the Apostolic Prothonotary and the Apostolic Secretaries.

    Can. 7: The Superior Council of the Nunciature is charged with advising the Chancellors and the other members of the Council itself in the exercise of their functions, as well as serving as a meeting place for the coordination of diplomatic activity.

    Can. 9: An Apostolic Secretariat is set up for each geodogmatic zone, regrouping the Apostolic Secretary in charge and the corresponding Apostolic Nuncios and Ambassadors.

    Can. 10: Each Apostolic Secretariat accommodates the offices of the Apostolic Secretary and the related Apostolic Nuncios and Ambassadors and serves as a meeting place for the coordination of diplomatic activity within the geodogmatic zone.
