Direct referral for the dissolution of the marriage between [Donnaginestra] and [Grimaldo]
We, [Aerwan], in the capacity of Prefect of the Tribunal of the Roman Rota,
Considering the request for dissolution of the sacrament of marriage between [Donnaginestra] and [Grimaldo] filed on 28 January, 1474,
Considering the admissibility and relevance of the aforementioned request for dissolution of the sacrament of marriage;
Considering that the matter raised is not particularly complex and does not require investigations for the instruction of the proceedings;
Having regard to Canons 33, 42, 43 and 44 of Section C, Part IV, Book IV of the Code of Canon Law;
Refer directly to the Tribunal of the Roman Rota the decision on the aforementioned request for dissolution of the sacrament of marriage;
Appoint as members of the Tribunal for the proceedings ourselves as President and the Auditors [Puta_z_ryzmberka] and [Gonzalo_valmont];
Set the date of the first hearing for 29 February , 1474, with a term of 7 days from the date of the opening of the proceedings for the appearance of the parties;
Entrust the Rapporteur [Ferecide] with summoning the spouses and the witnesses to the proceedings, sending them a copy of this provision and indicating the deadline for appearance;
Remind that, in the event of failure to appear within the established term, the proceedings shall continue in absentia and that only within such term may the parties submit a request for recusal of one of the designated members of the Tribunal.

Noi, Aerwan de Mortelane Viceprefetto della Rota Romana , davanti all'Onnipotente e sotto lo sguardo di Aristotele, per grazia di Dio e di Papa Sisto IV,
- vista la richiesta di scioglimento del matrimonio tra i fedeli Donnaginestra e Grimaldo
,
Il matrimonio fu celebrato il 16 febbraio 1470, Udine. Il celebrante è Eminencia Ettore Aburgo d'Argovia
- visto il parere espresso in merito dal Tribunale della Rota Romana l'28 gennaio 1474;
- visti gli articoli del diritto canonico relativi allo scioglimento del matrimonio;
Abbiamo stabilito e ordinato, e con il nostro presente editto perpetuo e definitivo, diciamo, stabiliamo e ordiniamo:
lo scioglimento del vincolo matrimoniale dei due coniugi sopracitati.
Inoltre comminiamo le seguenti pene:
per lo sposa:
- l'obbligo di confessarsi, come condizione necessaria per un nuovo matrimonio, al proprio vescovo o ad un altro prelato della propria provincia ecclesiastica e di ottenere il relativo attestato;
per la sposo:
- l'obbligo di confessarsi, come condizione necessaria per un nuovo matrimonio, al proprio vescovo o ad un altro prelato della propria provincia ecclesiastica e di ottenere il relativo attestato;
- l'obbligo di versare come penitenza presente sentenza, la somma di 100 (cento/00) ducati alle casse della diocesi in cui si trova, previo accordo con il vescovo titolare, che dovrà rilasciare una ricevuta e consegnarne copia al presente tribunale.
- vietare al coniuge di risposarsi per un periodo di 4 (quattro) mesi a partire dal suo ritorno alla vita attiva;
Ancora, avvertiamo:
Che Avverso la presente sentenza è ammesso ricorso presso Questo Stesso Concistoro entro il termine di 30 giorni dalla sua pubblicazione.
Il tribunale della Rota ha il compito di vigilare affinché i coniugi adempiano scrupolosamente alle penitenze prescritte.
